The reality is it's actually quite hard to do so, hence why it's not enforced that often.  But besides that, the law is written in that they must determine if they would likely become a public charge, not if they could recover those funds later.

yeah for sure the rule is so new there will be clarifications in a few days and probably a law suite as well to block it :). I think my point would be if you could purchase insurance before going then that insurance becomes an objective check-mark that says good to go, but yeah it's hard to cater for all cases.

You can’t make a rule that covers every situation ... yes , that’s part of the problem with doing it this way 

The mess we are seeing right now is what happens when a sweeping policy is “ announced” without the background and practical out working of the policy being forthcoming at the same time. I can only imaging the scrambling and hair pulling occurring in the government departments who will have to work this out. If we are confused and stunned ...... 🤪

It'll be lawsuits up the wazoos. Every immigrant advocacy group in the country will file suits and injunctions on it and it will take years for the court battles to play out, probably it won't be over until well after the Trump Presidency is over...

 

Edit: Two immigrant rights groups (United We Dream and The Refugee and Immigrant Center for Education and Legal Services) are supposedly preparing to file suits. New York Rep. Alexandria Ocasio-Cortez already characterized it as “Hypocrisy, xenophobia, and barbarism all in one policy" and Sen. Patty Murray of Washington noted that “it seems every day the Trump Administration reaches a new low of cruelty.”

They are already suing. 
 

"The new order comes on the heels of another controversial Trump administration policy — the public charge rule — which will make it much harder to immigrate legally to the United States. The rule will deny a green card or other visa to applicants based on a number of factors, including age, education level, family size, and current or prior use of public benefits, such as food stamps and Medicaid. The public charge rule is set to take effect on Oct. 15, unless the courts block it. Currently, more than a dozen states have filed lawsuits challenging the rule, which could delay the effective date."

Good Morning what would i say to the insurance company. I just asked my job about open enrollment HR said I couldn't add them without ss#. She said I can't use marriage because we married in 2018 by the time they come i will be going on the next year of benefits. Thanks in advance

Yes you missed the qualifying event,  but during open enrollment you should be able to. You might have to go over someone's head as they are denying you benefits essentially since you are married  and adding ur spouse. If you are otherwise qualified I'd  go to the next rung on the ladder  and ask why not? Explain your situation. Your spouse  must be here though  to add.

yes i agree thank you for your input. I read over there paperwork it says to be covered you have to have ss# I can't give what they don't have just yet so yes I will fight this when time come Thanx

Wait a minute, I thought a SSN is not required to be enrolled in insurance?

Once open enrollment comes along, try again. Ask for a supervisor if needed.

Ask them what they do for newly born children. ;)

Correct. That said, that doesn't mean everybody knows it, even the tier 1 employees.

It's  not but some  companies  are ignorant  or just plain refuse.
