99% of regulatory code wasn’t passed by congress.  Once Congress gives leeway to one of the branches they start writing, leaving the courts to decide if what they write is what Congress intended (because Congress isn’t sitting down the street to clarify what they intended and all).

Guys I read the original rule. According to that, this will not apply to parents visa IR5 provided that parents or their sponsors provide proof that they will not be  a burden on government. So it is just the same thing as was implemented on Jan 2018. Why we are arguing and wasting our time?

I think we are forgetting that this healthcare requirement is a step toward a merit-based immigration system.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

My employer does not offer insurance and the marketplace for me is close to 400 a month. I can't pay that. So I go without and self treat. Im young and pretty healthy. We have my husbands interview Oct 28th for his green card. When he gets his green card he will get insurance quickly (soft job offer) so while we knew we needed insurance we have just been waiting until he can go to work.

 

Now Im scared that he will be denied his green card. So Im looking at plans. We could just get him a plan right? I mean the US doesn't give a flip whether I have health care or not right? So we could get a plan that covers accident/hospitalization only?

If this pronouncement is supposed to be part of that change ... it reminds me of the  country that decided to change from driving on the left hand  side of the road to driving on the right hand side of the road ..

They  had  the trucks and buses make the change on Monday... and the cars and taxis on Tuesday !🤪

That statement was referring to Freedom of Speech.

 

Allow me to clarify... the previous sentence I stated  "Even if it is to vent their frustration, people are free here to express their opinions on this topic as long as it is respectful and civil". Then I followed with, "No moderators, members, visitors nor anyone else should suggest otherwise." The key word is "otherwise".

 

The second sentence means that nobody show suggest something other than (or otherwise) the first sentence, which is allowing people to express their opinions freely.

Yes, a spouse can be added without a SSN.  Things may still change a bit before your interview.  I'd check back in before and see what is going on.

An SSN is NOT required to obtain health insurance in this country. Those couples married and lucky enough to have an understanding HR or insurance agent of the law can very successfully add their spouse to their health insurance. Of course for K1 couples health insurance is a little more tricky until the marriage happens.

It is unknown how the terms of the proclamation would affect an AOS application at interview. I don't see it being a far stretch, but it is poorly worded and little is known. Since you have your application in before the October deadline, even if the interview occurs after the deadline, your case is based upon the old rules of self sufficiency where health insurance is not a factor. However, no one can guarantee what an officer might be interested in. If you had applied for an EAD with your AOS application, your husband could have been working already. You could get him any plan that is offered in your state right now, the same as yourself privately. Of course there will be cost for that. You could try and obtain a short term plan, but these are not ACA compliant and their coverage is dubious at best. I certainly understand about the cost, it's one of the many reasons that people choose to go without, but it is a good form of comingling for the future and is one of those responsibilities as a sponsor.
