Very possible. My remark was that there is strong precedent for different rules for USCs and existing residents versus those applying for a visa. The original remark was that there cannot be different rules for different sets of people - my comment was an example where there is exactly that.

Since it’s healthcare?  Yes, the mandate should (as it was) apply to everyone.

Totally agree.  It is not safe or responsible to not have health insurance in the United States.

Definitely that new affidavit of self sufficiency specifically asks about subsidized health insurance premiums.

I just read through the I-944 affidavit of self sufficiency, and wow, it is really thorough!

 

At what stage of the IR1 visa process would the petitioner need to fill this form out? Same time as the I-864, right?

Hey guys, 

 

Does anyone new if the new health care rule/law that will go in effect in November 3 applies to removal of conditions? It says that immigrants who already have a visa are excluded. My case status at the moment says waiting for an interview. I have insurance through the health insurance marketplace.

I see that this law will take effect on October 15th. I am planning on sending my packet in on October 8th (Tuesday). Should I send my AOS packet with the new form required and proof of health insurance?

  1. Proclamation, not a law. Laws are voted on by Congress.
  2. This takes effect in November.
  3. This applies to immigrant visa applicants, not K-1 visas or AOS.
    1. The October 15th DHS rule that applies to AOS is discussed on another thread. That requires the I-944.
