They may have in fact have actually adopted said policy,  but unfortunately that is where it ends.  It is a goal that they may not be accomplishing.

Thank you, all that I was trying to say is maybe, there is hope in sight for those who are in AP. They MAYBE, and it is a big maybe, they can convince the embassy to act upon their application in accordance to the law only if they can educate the CO (because who knows, could be that the mere bringing up this portion of the law would call there attention to the undue process they are committing). HOPEFUL thinking that's all, that the delays are are but simply ignorance of the law.

@Boiler why the laughs? Is it wrong to be hopeful and to give others hope? Had this matter been raised before with any embassy and been proven to not work? I mean, it is worth a try, don't you think? It is the same law being cited when attorney's file for Writ Of Mandamus, so why cannot an applicant proactively bring it up?

My only comment is that if this was actionable or litigable,  AILA would have been all over it

Nope.   From AP it can go to READY but there is no announcement that AP is complete ..  once the reviewing is done it is ISSUED or DENIED/REFUSED

Sadly, I think it is safe to conclude that my case is sent for SAO. An email received by my husband states "The Department of State is continuously working to refine our visa application, assessment, and security screening procedures.  Please note that every prospective traveler to the United States undergoes extensive security screening.  This screening draws on information from the full range of U.S. government agencies.  No visa can be issued unless all concerns raised through the screening process are fully resolved." OMG I had to brace myself for a lengthy wait time. My poor husband cannot even file for disability benefits he needed because it will affect my immigration case.

Disability is not a Means Tested Benefits.

 

Social Security disability benefits are not means tested, although beneficiaries may lose eligibility if they engage in substantial gainful activity. Benefits are funded by a dedicated payroll tax paid by a worker and the worker's employer and by taxes paid by a self-employed person.

But this could jeopardize us not meeting the income requirement.
