Received an update for my father in law's case- MOVEMENT!  This is his I-765.

New Card Is Being Produced

On January 21, 2020, we ordered your new card for Receipt Number MSCXXXXXXXXXX, and will mail it to the address you gave us. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

So today I received our RFIE and I am a little bit worried. The first part is for the I-864 and it states:
- you have submitted Form I-864, Affidavit of Support. We are unable to process the I-864 because it has one or more deficiencies. In order for us to process your application further, you must:
Submit a completed and signed form I-864, Affidavit of Support, from the petitioning sponsor. All pages must be present and of the latest edition date. The date needed is 03/06/18. I swear we sent everything complete. I guess they lost it.
provide a complete and correctly calculated household size for the petitioning sponsor on Form I-864.
Submit a complete copy of the petitioning sponsor's Federal income tax return, including all supporting tax documents (W-2s, 1099, Form 2555, and tax schedules) filed with the return, for the most recent tax year. I am terrified because we cannot find my husband's W-2 for 2018 (we haven't filed our 2019 taxes yet). Originally I had sent them the tax account transcript, so that's why they might be asking for his tax return again. I know that in the original application you could send the tax returb transcript without the w-2 if it was an IRS transcript, but here it is asking for a w-2. What happens if we don't have it? Are we going to get denied if we send the IRS return transcript without the w-2?

Any suggestions? Again, why do they ask for a joint sponsor if he makes above poverty line?

Tax Account Transcript and Tax Return Transcript are two different things.

 

Tax Account Transcript is not accepted by USCIS, so that's probably why you got the RFIE.

 

Send a new affidavit with a Tax Return Transcript, employment letter and paystubs, and you're good to go

Just to add to what Aryton said, you can get your Tax Transcript by going to the IRS website---->: Get IRS Transcript

 

After clicking on the link, go to the section for "Get Transcript Online" (see 1st screenshot).  You will then want to sign up for a free account.

 

After signing up, you will get a question as to why you are requesting your transcript.  You can select "Federal Tax" and then click "Go" (see second screenshot).  

 

Select the "Return Transcript" for the tax year(s) you need and save the pdf.

Congrats to you and everyone who had their EAD!

 

I'm a bit sad because my EAD is still no where to be found. Granted that I received and responded to a RFIE 50 days ago, it is still quite discouraging. I tried calling USCIS yesterday, but of course I got the answer from the transcript. Should I call them again after 60 days of inactivity?

We sent my Federal Tax Transcripts for the last three (3) years with the I-864 document, 6 months of pay stubs (not required) and a letter from my employer stating my hire date, position and salary.  We didn't send in W2's or tax returns. 

 

The tax transcripts can be sent instead of W2's and tax returns.  What I don't know is if they are specifically asking for W2's and tax returns and you provide the tax transcript if they will give you an issue.  

 

Your husband may be able to request a copy of the 2018 W2 from your employer.  They should have copies of these on file.

 

Per the I864 instructions:

 

"Item Numbers 23.a. - 25. Federal Income Tax Return Information.

 

You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years. You are not required to have the IRS certify the transcript or photocopy unless specifically instructed to do so by a Government official; a plain transcript or photocopy is acceptable.  

 

If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income."
