I think a lot of the law around fiance(e) and spouse visas date from when single-income families were much more common. Though AOS processing has been much faster at times.

I agree with you! But also that it is how it is with the K1 visa. Hence, the reason more people apply for the CR1 visa

Hi. My RFE letter is here. Finally and they asked for a long form birth certificate and translation. I have sent my copy of birth certificate and translated that I used for visa interview. Looks like it does not satisfy them. Any advise what I should do? And I don’t really understand what long form means.

Hello everyone, thank you so much for being a great resource for everything. Quick question, we filled out I- 485 on October 9 and got our NOA 1 on the October 17. We been waiting for our finger printing letter ever since. It’s been 53 days since any update. My question is it normal to take this much time. Should we call the office or should we wait out and see?

I’d suggest that you call USCIS. Those letters for biometrics tend to go right after NOA1. Perhaps they scheduled an appt and you do not know about it.

We have the same NOA date as you, and we haven't received our bio appointment letter yet, too. I don't know if it's normal to take this much time, but you're definitely not alone. We called the USCIS a couple weeks ago...they weren't able to give us any useful information. Still, you should try to call them. They will open a service request for you.

I’m done with biometrics on 11/29, but my status still shows that “We received your case.”  
I haven’t received NoA letters yet, so requested last week. 
 

I have a trauma of this “delayed letter” and “no change status” because my initial AOS application was denied because of those things and this is the second application with paid fee again.

I agree with you.  The law often doesn't keep up with the times and this is unfortunate because it needlessly hamstrings couples trying to make ends meet in an expensive country.  This should be looked at but don't hold your breath.

 

On an unrelated topic, another thing that vexes me is making the K-1 a single entry visa.  Spare me the fraud marriage argument for why this is done (if that is indeed an argument for it).

 

We are bringing human beings into this country, human beings with family, etc. in their home country.  Circumstances can arise over the course of a year that might require a return to their country.  That's why we have AP right?  Great, but it's taking most people at least four months (and in many cases significantly longer) to process this???  If you can't provide prompt turnaround in this regard then make K-1 a multi-entry visa in case something unthinkable happens and these people need to return home in a hurry to attend to personal affairs.

I had this discussion the other day with my husband. I've been in the States for 7 months now and I'm getting so homesick, missing my friends and family and my hometown. 

There was even a death in my family that happened in July and I couldn't be there to attend the funeral 😔 

 

The single entry policy is just unnecessary and cruel. 

They could at least change the policy and put boundaries on it - for example, make it so we are allowed to return to our home country BUT maybe only for a limited amount of days or something. Anything would be better than this ridiculous single entry rule.

They cashed your money the first time and made you pay again?!

Yes, because they don’t admit their fault. And if you got denied and the reason was unreasonable, you can appeal but it takes long and another money for an attorney, so most of the people reapply after denial. 
 

I really pray this process goes smoothly now!

We got RFE letter before three days ago the due to answer the request. We couldn’t make it. We didn’t know what documents we need until we got the letter and we had to enclose the copy of RFE to answer. Couldn’t!
