OCTOBER 2019 AOS Filers

We filed a few days before you and got our I-485 NOA dated October 8, and we're STILL waiting on our bio appointment letter (just like you). We did call the USCIS last week to ask about it. We talked to a tier 1 agent and filed a service request over the phone. The USCIS said they will respond within 30 days, but I suspect the response will just tell us to keep waiting. It sucks seeing everyone else get their appointment letters while we wait, but waiting is just part of the deal with the USCIS. You're not alone.

Thanks for your reply. I mail AOS on 11/10, delivered on 15/10 I got my NOA text message on 1/11, i got the hard copy on the 6/11. I

Do not go off what everyone is reporting. Each case is different and it is handled accordingly. The moment you start thinking why everyone else and not me ; it is the moment you will start losing the battle. Remember, we will all get there ; it is just some cases are processed faster than others.

My apologies, I take my words back! Based off on other people’s experiences with their bio letter, it is possible that they have already scheduled an appt for you and you do not know anything about it. If I was you, I would call USCIS and inquire about it.

Sometimes cases move ahead and never get updated. The online system is not reliable. In addition the AOS is a 6 plus month process so we will all be waiting for sure.

Hello everyone... hope you all had a great thanksgiving.... i have a concern and a question... so i have been reading a lot of comments regarding the I-94 being expired when submitting the AOS...

My husband arrived on July 30th 2019, we got married on Sept 13th, and I-94 expired on 10/27/19, we submitted AOS on 10/08/2019 and it was received on 10/09/19... so that means that we are good, we submitted AOS before the I-94 expired... but my question is... why are a lot of people worried about their expired I-94 at the time they submitted AOS? will this result in a negative situation for them? some people are even saying that people can get arrested at the AOS interview for having an expired I-94 prior to AOS... I am confused here

You only have to be married BEFORE your I-94 is expired as that is 90 days. There is no set time as to when you are required to file your AOS insofar as your I-94. Once your I-94 is expired you are out of status and in rare cases you are subject to arrest and deportation (it has happened a few times). However if you have filed your AOS you are granted permission to stay in the US while your case is pending. An expired I-94 has no bearing on your application in the respect of whether it is denied or approved. It is strongly recommended that you marry (requirement) and file your AOS all within your I-94 validity.

 

The worry that you are seeing is not about the interview, but about the possibility of being picked up by ICE and detained and or deported because of being out of status and not filing the AOS.

there is this guy who just posted that his wife has watched a lot of videos regarding AOS and expired 1-94.... people getting arrested for having an expired I-94... i was just curious to know what was all of that about, and how does that affect anyone of us... thank you so much for your response 😍
