I have a small concern. Pretty soon and hopefullly I get NOA2. I will have to send I-134 to see how much I make. Last year, as a part time, I made almost exactly 19K. I was in school for 3 yrs and now have a Associates. My question is should I get a co-sponsor just to be in the safe side? Or this should be enough? Because I dont have that much in the bank and I dont wanna make "big" deposits so they wont suspect anything bad.

Anyone been in the same situation or what can VJ recommend....thanks guys.

The minimum is the minimum. They don't make qualitative judgements on whether you're over the minimum by enough. Go to the immigration forms section of www.uscis.gov and look at form I-864P. That will give you the amount you must make. You just need to prove that you hit that mark.

Ok thanks, I just want to make sure that I will be ok with that amount since I made just enough but its been on my mind that they might say something about that.

Depending on the country and circumstances, the Consular officer may well consider your low income in the approval process but if you meet the minimum, you meet the minimum and don't need a co-sponsor. You don't mention whether annualizing your current income would be greater. This is also allowed. The I-134 has you making a statement of current income. It's ok to annualize (12 months, 52 weeks, 2080 hours etc.) the income from your current job. You are not required to use last year's total on this line of the form. Your tax returns will show historical income. Your Employer letter and pay stubs will show evidence of "current income". Current income is the most important.

Facts are cheap...knowing how to use them is precious...

onofre, remember that Ciudad Juarez doesn't require the I-134 (but people use it because it's easier). You still need to meet the minimum requirements, which you do, so there is no reason for concern.

I have a question concerning the I-134 form, as well.

Although I am the fiance, will the Vietnamese-U.S. Consulate allow my sister to be

the sole sponsor, instead?

I'd appreciate it if anyone could give me an answer on this.

I believe the petitioner needs to be a sponsor. If the petitioner does not meet the income requirements, then a co sponsor can be used.

Thanks for that tip, believe me, everything you guys say makes me more confident and have a good idea on what I need. Its just that I dont make 30-40k like most people do and just made the requirement. But i'll take your advice! thanks guys!

I believe the petitioner needs to be a sponsor. If the petitioner does not meet the income requirements, then a co sponsor can be used.

I am going through the process and this question of "co-sponsorship" seems to be much debated.

Initialy I thought that the Petitioner had to be the primary sponsor. But on doing a bit of research here I changed my mind. I have a lawyer helping me with my case (wouldn't have hired her it if I had found this site first) and she also intitialy told me that I had to be the primary sponsor. I asked her to check into it a bit more as I now believed that with the 865? this is true but with the I-130 it isn't. She got back to me and agreed so when my fiance sent in packet 3 she sent in the I-130 with someone else as a sponsor and not me.

She doesn't have the Visa yet but she did just recieve Packet 4 yesterday with an interview date for the 29th of this month.

Unfortunately she, being a teacher, has a weeklong class trip during the time of the interview so we are trying to figure out what we will do now...

That said, I am confident that for the I-130 only one sponsor is needed (there really isn't any space or instructions for co-sponsorship anyway).

Good luck

onofre,

You've failed to provide the most important pieces of information - what is your current income (on an annualized basis) and is that income sustainable (from 'permanent' as opposed to, for example, temporary, short-term, or limited-time contract employment).

bszoom42,

Not for a K visa. A sponsor may not be required at all for a K visa - required only if the visa applicant does not have sufficient financial resourses of their own.

Granted, most of the time a K visa applicant doesn't have sufficient financial resources of their own, but if they do - and some VJers have - then a sponsor is not required.

Yodrak

I believe the petitioner needs to be a sponsor. If the petitioner does not meet the income requirements, then a co sponsor can be used.
