Are hold ups due to background checks on both the petition and beneficiary side or one or the other? 

 

As the petitioner, I have a few marks on my background from 16 years ago. But everything has been resolved and are not violent or domestic related issues. 

 

I know my fiance has nothing in her end

Background checks are initially done on the petitioner when the I-129f is submitted. I hope you put everything on the form that was asked for. I don't know what "few marks" are but you need to revisit that question to determine if you answered it correctly. USCIS may contact you with a 221(g) to veriry your "few marks" and you must be totally honest and here is why... here is another member of VJ and his story.

 

"I failed to mention a 30 year old misdemeanor arrest that was dropped and later expunged.  It was my fault and partially the fault of the company we used to help with the petition.  The governments instructions were very clear.  The company we used was not as clear as they should have been.  Since there are no public records and no possibility of me getting any information, I assumed it was no longer an impediment.  The expungement ordered all records, digital and hard, to be destroyed.  There was no record that I could produce so I failed to add it to the petition.  That was my mistake and we were denied because of the petitioner failing to disclose information in the petition."

Everything was divulged on the form as well as providing certified copies from the court and State. 

 

I'm just curious how long of a hold up are due to background checks. It only takes a few days to run a check, not months.

Can I share somethings with you that I learned long ago about this process

  • "the man with the gold makes the rules" and
  • it will take as long as it will take 
  • no one with any certainty can tell you when some process will be completed
  • Your sense of urgency will never be equaled to what USCIS, NVC or your embassy demonstrates
  • Lowering your expectations will make you a much more relaxed individual

sigh, could use some good news for sure! I saw that the case with the receipt number just before ours got approved on Friday so I’m keeping my fingers crossed even though I know it doesn’t mean anything:(

Another way of looking at a RFE is the adjudicator needs a bit more information to finish your case. An adjudicator would not send an RFE if they didn't think you were going to be approved on the merits of what has been sent so far. If the additional information is satisfactory to them then your case will be approved. So is your glass half empty or half full?

Hi, I did this already. I followed your link to be in the February thread when you mentioned it to me. I've downloaded the PDF & read it. I am just waiting for time to pass to call NVC for my case & invoice number. Do I need to be in the March Thread as well? Thank you.
