Public Charge form DS-5540

 

It has been reported that a CR-1 visa applicant at their interview yesterday was requested the new DS-5540 form. As the applicant did not have one, he was put on AP and requested by way of a 221(g) to complete one and return it to the embassy. Once received the entire case will be adjudicated to an outcome.

 

Since I can't say if this is true for K-1's, as I heard, they were exempt if they had filed before Feb 24th. Since this is so new and so many speculations are whirling, we will hear different stories until the dust settles. 

 

This is all I know. I'm not going to be able to answer any questions because we and I don't know what the requirements are and how each embassy is going to handle this. I recommend that you get a copy of the form and have it filled out for the interview to circumvent any delay.

@Greenbaum Where would this form be located? On the consulate's website? I did see this link which says at the very bottom that these forms might be requested for the K-1 applicants, however, I-864 would be required after admission in the states and marriage within 90 days. https://cliniclegal.org/resources/ground-inadmissibility-and-deportability/public-charge/state-departments-new-fam-public

Not sure how accurate everything is, but why not be prepared! I'm glad I checked this thread and saw your post. People must think: Oh, this person is around all the threads. Yeah, you bet! I want to be informed. Especially when I know people like you, @Greenbaum, are SUPER knowledgeable. I for one have learned a lot by being around and present. Thank you for all you do!

Good Morning everyone! Our case was approved. I checked on https://egov.uscis.gov/casestatus/landing.do and it says our case was approved today. 

 

Case received: 10/25/19

NOA1: 11/01/19

NOA2 Hardcopy: pending... awaiting its arrival in the mail.

 

I did not receive any emails, text or notifications via my account. I will keep you all updated!  

 

We are not sure what the next steps are, can someone please help us? Thank You!
