Timeline

I received the RFE in mail asking to send one passport size photo of the applicant. 
I am happy that it is a simple requirement to fulfill. However the instructions say that “the photo must have been taken within 30 days of filing this petition”. I don’t have any older passport size pictures . Can I take a new  passport size picture and send it ? 
good to also send a cover letter explaining what I am sending? Suggestions? Thanks

Yes you can. They are asking the latest one. Is it just you or both beneficiary and petitioner?

Thanks Lyn.  they are asking only for the petitioner. They didn’t specifically mention the latest photo. I think my photo was just a bit darker than normal... so maybe that’s why they are asking this. it was Fedex people who had to take my picture literally 3 times and it looks like they still got it wrong. But I am going to get a new one at some better place and send them right away.  
good to have a cover letter as well I guess?

Whining was the politically correct version of what I wanted to say, the wait is annoying enough without the incessant complaining.

Thank you so much! We actually received an email from them with a pdf. I am waiting for my fiance to send it to me to see if it will suffice or if we need them to send us more. We've also applied for a general police clearance from Switzerland so I hope that this plus the police report, ticket and fine receipt, we'll be fine.

You are best served to product a new picture in accordance to the requirements (link below). A cover letter is fine but you MUST read the RFE and follow the directions as they are written. No deviation. I know they will as for your RFE be a part of the returned paperwork and since it is only one small item you can create a cover letter or just return with the RFE.

I was sorting the approvals by NOA2 and yours popped up first. Our mailing date and NOA1 are the exact same as yours, so I'm HOPING we'll get our NOA2 soon as well!! Congratulations!
