October 2019 I-129F FILERS

Timeline

Received NOA1 hardcopy in the mail today, but I, the beneficiary's middle name and country of birth was not indicated.

Is it ok, or should we contact USCIS for corrections?

Nothing to do on your part till the interview where you want all information to be correct. Sometimes they leave things off, or mis-spell a name when addressing a letter and they are just errors and if they follow your record to the interview then you can make changes there.

Citizenship Complete!

One to two weeks sometimes as much as 4 weeks. NOA1 is never used for any of the process so if you don't get a copy it's not going to change anything.

"This requirement will apply to all immigrant visa applicants and individuals seeking to enter the United States on an immigrant visa, except: 

  • Applicants for K fiancé(e) visas and other aliens entering the United States without an immigrant visa, including lawful permanent residents, refugees, and asylees."

K-1 Visa applicants are exempted from this requirement. However, it would be wise to have health insurance regardless.

You don't. You're exempt from this mandate as a K-1.

Hi all!  I have a question: I am a US citizen petitioning for my fiancé using the K1 visa, would the fact that I may owe a medical bill affect/prevent us from getting approved? 

 

A few years back I visited a hospital while I had insurance, the hospital sent me a bill but I never paid it because I knew I had insurance. I left it at that & never did anything further which I'm now regretting. 

 

I heard as a rumor having an outstanding medical bill affects the process in a way. If someone can shed some light on this it'll be greatly appreciated. Thank you! 

 

I'm sending in my application tomorrow, after that I'll complete my profile. 

 

Sorta like a checklist to calm my nerves, does anyone mind reminding me what I need to out in the envelope?

I don't think that your outstanding medical debt will affect your I-129F petition or K-1 Visa application because the I-134 does not require you to disclose your debt. However, the I-944 does but that is not a required document at the moment.

Unfortunately, I don't know the correct answer to this.

 

However, because of the questions on the I-129F, I am inclined to think that the background check is only for criminal history. I think that as long as you answered "Part 3. Other Information - Criminal Information" of the I-129F truthfully, you should be fine.

 

I think that your outstanding medical debt--if it were to come up on a background check--should not prevent your petition or application from getting approved since you were not asked to disclose it, ergo there was no misrepresentation. Besides, there is currently no rule that renders ineligible those who have outstanding debts.
