I think it's a strong case. But I'm worried because I've never been approved an EAD. I sent the I-765 for an EAD along with my I-360 almost 2 years ago and it's been 'processing' ever since. But it looks like everyone else had their EAD sent after just a few months! 

If anyone has any idea why, I'd love some advice!

If your spouse is a US citizen you should get your combo card long time ago if not have you ever involved your Congress person to inquire on your behalf

I have the same process as you are. from what I understand here everyone gets their EAD long ago because they filled under marriage based I-485. Their EAD Category is C-09. In my case my USC ex-husband didn't fill anything for me. when I file for VAWA my EAD is under the category of C-31 which will automatically approved when my I-360 got approved. You will receive your EAD when your I-360 is approved (most of the time you will get it before your I-360 approval letter)

Is your spouse a us citizen if yes then you are eligible not only for the work authorization but for advance parole as well and the processing time for this is 7-8 months after that you can raise a query with the USCIS or you can involve your Congressmen to inquire for your self strange things why you waited that long

Thanks for that info! I don't have a lawyer so I didn't know any of that. I just read all the form instructions and filled them out accordingly. Everytime I've inquired about it with Vermont they have told me to just keep waiting for a decision. So I have been. I wish I could afford a lawyer, but without being able to work it is literally impossible. The irony!

Lol no! Not another 21months!😀 usually after sending in RFE response, USCIS can take anywhere from 30 through 90days to respond..usually with an approval!🙏 after I sent in my RFE they approved me within 60days..that was in March this year! So relax and PRAY! Goodluck!

If your ex is a US citizen you have to file the Form I-485 Adjustment of Status  with the Form I-765 under category C09 and Form I-131 Advance Parole.  

 

You can alweays file those forms with your VAWA Receipt attached. Go for it!

 

The reason why you did not get the EAD yet is because you only filed the Form I-360, Category C31.

You can file yourself..it doesn't have to be filed by an attorney my dear! Try to read previous threads to get a grasp of the whole VAWA situation! You'll be fine believe me!😊👍

If your spouse is a USC you should file for C9 EAD that's when you'll get it approved before i360 approval! But if not you'll only get C31 like most of us got after i360 approval!😊👍
