Hello everyone, update on what happened during my marriage-based interview in USCIS Field Office Omaha:

I went to the office 30 minutes before my interview schedule, alone. There was at least 10 people in the waiting area, I assume most of them are with their spouses and attorneys. It made me nervous because I was the only one there who didn't come with anyone. I waited about an hour before my name was called. It was very nerve-wrecking, and I anxious the whole time. A male officer called my name, and it took me a few seconds before I was able to stand up. He asked me if I was with anyone, and I said I came alone. He brought me to the other side of the building, and not where the other interviewees are brought. This scared me because I don't know what's about to happen next. He opened a room and told me to come in and sit and as soon as he closed the door, I started to cry. I've been holding it since I got to the field office. He told me to wait in the room and he's just going to get something, and after a few minutes he came back with a box of tissue and a bottled water. He told me to calm down before we start to discuss anything. After which, I told him that I was planning to file for VAWA, and if he could give me 30 days to gather the documents I needed to file. He then asked me if I prefer if I wrote a statement of what my husband did to me, or would I rather give a sworn statement where he would ask questions and he would type in my response. I then told him that I would rather do a sworn statement. He promised that he will get me out of their office as soon as he could. He asked the following questions (Not the exact words):

- What is your full name?

- What is your husband's full name?

- Do you know where you are?

- When did you find out about VAWA?

-When did you and your husband got married?

- When did you get married to your husband?

- How did you and your husband meet?

- Where did you and your husband get married?

- What are the things your husband did to you? (As I was stating what my husband did, he asked me if I prefer that a female officer took my statement if it would make me more comfortable. I told him I was okay stating it to him, as my psychiatrist is a male)

-When were you last in contact with your husband?

- What is your safe address?

After he was able to finish the sworn statement, he made me sign in. He then asked me if my husband knew I was here. I told him I don't know. He then told me that if my husband ever find out where I'm staying in Omaha, that I should go to their office if I ever feel like I am in danger. He then asked me if I had any other questions. I asked him if he would hold my I-485 for 30 days until I am able to file VAWA. He then told me he's giving me until January 12, 2020 to file my VAWA and that he will hold on to my file and forward it to Vermont after I file VAWA. He also said that if I needed more time, I should write a letter requesting for an extension and send it to USCIS Field Office Omaha and address it to him. I then asked him how he would know if I already filed VAWA, and then he printed out an RFE asking me to mail a copy of my VAWA receipt to him. He told me that in that way, he knows when to forward my file to Vermont.

I thank God for this. It went well than I was expecting.

WOW! May God bless that officer and may God grant you favour in your petition!🙏🙏🙏 very very touching! Fear not my dear, God's got this already!😊👍

You already filed vawa a got your receipt right ? If you are looking for a psychologist to make an evaluation for you to send it to the USCIS .. i don’t recommend that unless they asked you for more evidence you can send whatever they asked you for .. otherwise your case process will be delayed ..

why the psychologists in Russia are refusing to give you statements for USCIS ? That’s wicked !!

The case won’t be delayed if she submits the psychological evaluation now,and it’s not a problem to submit before getting an RFE, specially because the immigration officer is not obligated to issue an RFE.

Hi all,

I have a quick question.
So I applied for EAD+AP renewal based on C9 (Pending Adjustment of Status based on marriage with USC).
Applied on July 4, NOA1 of July 16th, Fingerprint Review Completer on July 19th.

AOS is still pending but I got an update in July as well that it is ready to be scheduled for an interview.
But I moved in June and I updated my address with USCIS in writing as required for pending I360 applicants.
I didnt get feedback from USCIS that my address was updated before getting status update that AOS is ready to be scheduled for an interview.
So, I inquired help of congressman office as you dear fellows advised to do.
Later Congerssman Office emailed me that USCIS informed them that my address was changed and my interview will be scheduled at my new local office, but at my new place waiting time is MUCH longer, so it will not be anytime in next 6 months.
So, my question is... will my EAD+AP be extended automatically in 4.5-6.5 months after applying or AOS interview will be scheduled before extension will be granted??? Or both scenarios are possible?

Thank you.

EAD renewal is a different application and is also process withing their unique processing time, USCIS will verify if I-485 is still pending to granted you the benefit and approval. It could be approve before or after.

I thought evaluation is a must and you need to send it before a RFE is issued ... I think you should send it , do not wait for RFE ... get a evaluation done ASAP

this is for nataly from Russia - she should send a pyschologist evaluation now before waiting for an RFE

Thank you all for your help in finding a psychologist.
I keep looking further.
I repeat that even in the USA, psychologists refuse to give such statements to USCIS.

Keep looking..but you actually have to get a series of couselling..whether via skype or physically for them to be comfortable writing you a report. You can't just dictate to them what to write at first contact. The evaluation report is the end result/report of the sessions recorded..that way they are able to do their job independently!💁

I understand it.
They are ready to consult, but they is not ready to give documents about my assessment (although we have not even talked yet)
Because they are not familiar or afraid to give such a thing ...

VERY TRUE . In this process, you don’t give up.  All she has to do is keep calling and making searches. I believe calls from Russia to USA should be free.

The first time I started my research for therapists and psychologists, I was on the phone for over two hours. Comparing prices and I was getting referrals from professionals who don’t deal in vawa or DV. I had my pen and paper  making notes . Vawa is not a program that just started last night, it’s been here for years and these Psychologists know about it and they also know they have to give notes and assessments for government/USCIS.

Seriously I don't know the people you're talking to or the content of the discussion but any counselor/ therapist..etc who knows their job will understand what is expected of them..except you're not explaining it right to them..more reason you need a representative! Please understand USCIS will issue you RFE and I would like for you to be ready before hand! #very important!👍

Do you speak English, just a lil bit..I could speak to my psychologist and she can do an evaluation for you and Counseling. ?

Yes, I can speak English.
Also I can read English.
Sometimes I don’t listen to English (when they answer me) just by ear.
I am a very smart person, I just did not have the opportunity to practice English.

Thank you.

I can will  write my email for you.

I hope it's free..but she really needs a representative! The language barrier is proving to be a barrier in itself..probably she will find a good therapist who speaks Russian! It will make a huge impact!
