I apologize for the delayed response. An I-864 is not necessary for your case because it is based on VAWA. As for processing times, this varies because with the current administration in the White House - all processing times are a lot longer than what they used to be. I will pass on your email to Lauren to provide an accurate response

 

 

What can i do maybe thats why my I-360 toke 4 years and should i file I-864W myself since my lawyer doesn't see that this is necessary what should i do i don't want a nother 4 years for my I-485 to be reopen and rescheduled ( I-485 based on marriage with US Citizen I-360 approved 50 days ago  ) Can someone please advice ?

As @Stillwinning!!!😊 said, download it, fill it up and take it with you, it won’t delay anything. I got a RFE for it 3 days later and will mail back. Just complete it as you as the filler and not your attorney, if he/she by coming with you. Good Luck!

Two people refused to do this. Two different specialists. One of them advised turning to a lawyer, I think they don’t understand what I’m asking about. And at the mention of USCIS everyone is scared, as if it were so scary ....

Please, open the link above and call each of them tomorrow. Many of these professionals work with DV victims and know about vawa. 80 percent of us on this thread went for counseling and had an evaluation too. You’re making things more complex for yourself when you believe nothing can be done . Google is your friend too, make research . You’re not the first applying for vawa from overseas, if others could do it, then why can’t you do it ?

Hello everyone, update on what happened during my marriage-based interview in USCIS Field Office Omaha:

 

I went to the office 30 minutes before my interview schedule, alone. There was at least 10 people in the waiting area, I assume most of them are with their spouses and attorneys. It made me nervous because I was the only one there who didn't come with anyone. I waited about an hour before my name was called. It was very nerve-wrecking, and I anxious the whole time. A male officer called my name, and it took me a few seconds before I was able to stand up. He asked me if I was with anyone, and I said I came alone. He brought me to the other side of the building, and not where the other interviewees are brought. This scared me because I don't know what's about to happen next. He opened a room and told me to come in and sit and as soon as he closed the door, I started to cry. I've been holding it since I got to the field office. He told me to wait in the room and he's just going to get something, and after a few minutes he came back with a box of tissue and a bottled water. He told me to calm down before we start to discuss anything. After which, I told him that I was planning to file for VAWA, and if he could give me 30 days to gather the documents I needed to file. He then asked me if I prefer if I wrote a statement of what my husband did to me, or would I rather give a sworn statement where he would ask questions and he would type in my response. I then told him that I would rather do a sworn statement. He promised that he will get me out of their office as soon as he could. He asked the following questions (Not the exact words):

- What is your full name?

- What is your husband's full name?

- Do you know where you are?

- When did you find out about VAWA?

-When did you and your husband got married?

- When did you get married to your husband?

- How did you and your husband meet?

- Where did you and your husband get married?

- What are the things your husband did to you? (As I was stating what my husband did, he asked me if I prefer that a female officer took my statement if it would make me more comfortable. I told him I was okay stating it to him, as my psychiatrist is a male) 

-When were you last in contact with your husband?

- What is your safe address?

 

After he was able to finish the sworn statement, he made me sign in. He then asked me if my husband knew I was here. I told him I don't know. He then told me that if my husband ever find out where I'm staying in Omaha, that I should go to their office if I ever feel like I am in danger. He then asked me if I had any other questions. I asked him if he would hold my I-485 for 30 days until I am able to file VAWA. He then told me he's giving me until January 12, 2020 to file my VAWA and that he will hold on to my file and forward it to Vermont after I file VAWA. He also said that if I needed more time, I should write a letter requesting for an extension and send it to USCIS Field Office Omaha and address it to him. I then asked him how he would know if I already filed VAWA, and then he printed out an RFE asking me to mail a copy of my VAWA receipt to him. He told me that in that way, he knows when to forward my file to Vermont.

 

I thank God for this. It went well than I was expecting.
