Your I-797C is the receipt or NOA (Notice of Action) paper you received when you applied for VAWA, EAD and AP...

If a US citizen spouse-sponsor withdraws the I-864 for the I-485 before the green card is issued, and the beneficiary subsequently files a VAWA, can that I-485 be put on hold until the VAWA is adjudicated?  Or does she need to file another I-485 ?  Thanks

Have you looked through your documents? Take your time to go through them..you should have it..or if you're using an attorney ask them for it dear!😊👍

Sometimes these forms are confusing that is; in relation to each other..but I believe that if the i130 is still in place, then the i485 is good too!

Just take your i360 receipt or prima facie document with you..if you haven't filed VAWA yet, let the officer know you intend to do just that..some of them are considerate, others are strict..just ask politely..and plead if you have to!😊👍

State the fact that you have a pending i485 in your VAWA affidavits and submit the receipt notice or number. The basis of your i485 eligibility can be switched from i130 to i360. In my time, I didnt even tell them to switch the basis of my eligibility,  they used their own common sense to switch it. Best of luck

Fisrt, the Officer don't just withdraw the I-864 and I-485. They will schedule the marriage based interview and if your spouse or his lawer formally withdraw the I-864 , I-130 mostly like will denie you I-485 if you did not file for VAWA yet, or you can try to ask the Officer to hold it and sent them proof the you filed I-360 withim 30 days.

It says if a citizen spouse sponsor withdraws...NOT an officer! An officer has no business withdrawing that form!💁

The spouse or his lawer can request USCIS to withdraw but only the Officer can make a final decision.
