What is the difference between Legal Marriage and Religion Marriage ?

I never heard about Reglion marriage or reglion Divorce .

I am trying to help my friend She just lived in USA for less then two years.

Long store short .

She got married to abusive husband .

She Doesn't know anything about vawa .

After she told me her story I advised her to see lawyer and file 360 especially she has Good case and evdince , She is going to summbit the case by next week .

And I advised her to became member on this site to Learn more about vawa , She Doesn't really speak Good English and she doesn't read or write English at all , Russian is my first language and she does speaks Russian too .

After She got married in Civil Court with her Husband in USA then they decided to do Religion marriage at church or temple in usa as Celebrate marriage in religion way .

She had to get first Civil marriage in court in order too get religion marriage .

Actually after she got civil marriage certificate she was able to get reglion marriage certificate from church .

Now she is filling for divorce by the civil family court and she has final court day next week October 2019 .

 

At the church or temple they told her that She is not able to get the religion divorce  or it's very hard to get almost impossible but she will be able to remarried again in future if she wanted to  .. in her relagion Once she gets Civil divorce , the Religion Marriage will termented and Ended automatically but without Issued Reglion divorce certificate .

Because her Civil marriage related to reglion marriage .

Such as Condition Only able to get reglion marriage after getting Civil marriage , Once Civil marriage ended reglion marriage will Ended too .

I Didn't go into details with her but when she told me this story she said this is how is her Reglion .

So In front of God Her marriage will termented when she gets divorce by civil court and She Can't be Longer live with her Husband after that .

 

 For The legal part she has question .

 She Doesn't want face any problems in the future because of her reglion marriage .

Does it's legal to get Civil Divorce from Family Court and just leave relagion Part the way it is without getting religion divorce certificate without having any problems in the future  ? For USA law Is it Enough to get Civil Divorce from Family Court   ?

Like in Islam, we get married in Mosque and they issueD us islamic marriage certificate. But we had a civil marriage as well obviously when we went to court and signed the marriage certificate. Short story, there is no as such thing as religious marriage in usa. You can marry according to your religion but civil certificate is the one that makes you a married person

@NeverGiveUp Nov17 my vawa was approved nov 2018. feb 2019 I was sent a mail to send a new medical because the one I have on file is expired and we never received the  mail. Interview letter 9/30/19 at SFO. She pulled out my i485 and asked questions from there and updated some information like my Job and address. She asked how I came here and when. And asked for my documents and then the yes and no questions. She asked for my divorce papers but I didn’t have it with me.She also asked about my asylum application I filed when I got here and my lawyer told her it on a status doc or something. Not sure if the asylum will be a problem. Overall she was nice and interview lasted about 30 minutes.At end of interview, she gave me a rfe for medical.Goodluck to you on your interview

Generally after sending in RFE response right after interview you should be approved "anytime soon" yes anytime soon because with USCIS you just never know! It's only the adjudicating officer that can say precisely when he's going to approve you! But from the trend I've seen here in your particular kind of situation, it doesn't take long..you can be approved in a matter of days from now..or tomorrow..💁 the most important thing is that you've sent in the RFE which has thankfully been received! Relax and wait for your good news!😊👍

@LonelyButHopeful I went for my marriage based interview too. Told the officer same thing and she didn’t ask me for any documents. I think  all I needed was my ID for identification.SF office California

Yes , Bring the  Form I-864W along with a letter requesting the Officer to change the basis of your pending Form  I-485 that is currently based on the I-130 that your spouse filed to you thato to be based on your pending VAWA-Self petition Form  I-360. 

 

Organize it and have it in hand with you go to the interview.

Yeah, my attorney should’ve done a lot of other things that she didn’t, but that’s the situation now. And i’ve followed the conversation on this forum and didn’t see anyone mention that they brought this form with them, I had no clue this form is even required. Thanks anyways, I know this forum made me more knowledgeable about VAWA that my attorney would’ve ever done😉

Now i see, You did not file for VAWA yet.

 

you must notify the USCIS field officer adjudicating the pending Form I-485 that you have filed a VAWA self-petition or that you will do so within 30 days. You should also provide the USCIS field office with a safe address.

Should I still include a letter? Also, I just had a psychological evaluation done, but would have to re-do since it isn’t detailed enough. Should I bring that as well?

Yes,  bring the  Form I-864W along with a letter. Hopefully the Officer will hold your Form  I-485, but you have to file the I-360 ASAP


If he denies your I-485 you can file a new one with Form I-360

There is no religious divorce, there is "annulment" of marriage from the church in some religions. People sometimes file this kind of annulment because they want to remarry in the church again and it's not related  to a civil marriage ok.

 

Legally speaking she won't have any problem to remarry again (civil marriage). She has  to see with her church if she decides to have a church marriage again.
