Please Can someone clarification this Matter to Us with specific answer .

Basically

VAWA-approved spouses of abusive U.S. citizens can apply for naturalization after three years .

1-Will remarriage effect vawa 3 year rule after you Got GC thorugh vawa (married to usc)  will still eligible to apply for naturaztion or Citizenship under 3 year rule after remarried ? Does remarried will effect anything Or will change any Of this Rules ?

2-After getting remarried Should we file taxes joint with new spouse or better to file separately ?

We heard A lot of people has different opinions regarding this subject and it's Confusing .

Thank you .

I still remember Sandra's answer to question one: re-marrying will not affect the naturalization after 3yrs as LPR! Not sure about question two...I try not to give misleading answers!💁

The key word is “approved” . After VAWA is approved you can remarry with no negative consequences to your VAWA status. You get your green card through VAWA, it means you can get naturalized 3 years from the GC date. Your new marriage has nothing to do with it.

Just reading this thread... I have an I-485 pending from my marriage before I-360... never heard about I-834w, so I should file it? Not sure what’s the purpose of it, sorry I am lost...

Same here..it's i864w because we're self petitioners..as opposed to the initial i130 and i485 filed for us by our spouse where we had to send in the i864 affidavit of support! The former is to show we are exempt from this burden! Still not sure if we are required to get the i864w for those of us who already have a pending i485 with i864 submitted already. I have to ask my attorney if we have that in place already, if not will ask that they get it ready ASAP!💁

I just checked my whole package and back at that time I Have filled I-864 and I-864A, so now I don’t know if those are enough or I have to filed I-864w... not sure what the difference among them... will ask too!!!

It's basically the same thing the only difference is that you used a joint sponsor..I did same as well! But with VAWA you don't even need the affidavit of support, that's the reason for the exemption-I864w👍

There is a Form I-864 and I-864A; both are similar but unique forms with their own purposes. A joint sponsor prepares another Form I-864. A household member prepares Form I-864A, Contract Between Sponsor and Household Member.

This only applies for Applicant who Abuser was a US citizens.  Am correct???  For those applicant who abuser was an LPR  they still have to wait for 5 years right.?

Yes, the three-year rule just applies if the abuser is a U.S. Citizen,  if the abuser  is a green card holder then the  person needs to wait five years before applying for naturalization.

1-The person can remarry and apply for naturalization within 3 years of getting the green card if the spouse(abuser) is a U.S Citizen.

2-IRS gives a better deduction for those filing the taxes jointly.

@Screecher i want to say thank you to you as well you forced me to apply for it and I did and see it has been approved within two months.

@sandranj should I wait for an EAD card or i can show approval notice to my employer so that they can put me back on payroll? They approved it on October 10. Today I received notices and probably within 2 to 3 days i will receive my combo card IA
