It searches the case numbers around you case number by 500 ,, not all of them will be i360 .. some of the number not valid or there are no cases .. so the filter gives you only valid i360 cases among the 500 cases ..

They said there wasn't enough evidence and suspect of fraud. He has a child from another woman before he married me and he had put his name on her leasing agreement because they require a certain level of income and hers wasn't enough. We responded why he did that but they said that his word doesn't have much value because he put his name on the lease when he wasn't living there so he has a potential to lie or something like that. We appealed to Board of appeals and they said that we can file motion to reopen with uscis. Through out this whole process (6 years), I was really miserable and I cant live another day with him. I talked to a lawyer she told me about vawa.

I think you mean your I-130 and I-485 base on marriage was Denied, because they suspect fraud. Since you were going thru abuse your lawyer suggested VAWA. USCIS can pull out your I-485 information. Your are paying the lawyer she should know an abuse victim sometimes is unable to get a documents directly from abuser, Search Voting records page if ever register you can find him with his name and birth date. If you can't find them your lawyer should explain in writing, since you had a previous lawyer you can ask for your previous record documents and send copy of your I-130 or I-485 receipt so they can get the information.

When you submit I-130 & I-485 you have to submit Citizenship proof, You can ask the previous lawyer to give copy of the file they sent to USCIS a copy of his Citizenship or passport should be there. If you both hire an attorney to file you can get a copy of the file as well.

it makes sense now. you can ask USCIS to used your spouse citizenship document based on your previous application and explain why you do not have it available.

Hello,

I have a question. Applied for vawa about 6 months ago but never got a receipt. I have to re-send the other forms because I used old ones and I saw they had the zip code for my pobox wrong. So I’ve been sending them notarized letters asking for a copy of the I-360 NOA and any notices related to that application (PF, RFE) but I never heard anything back from them. I’ve sent about 3 letters so far and nothing. My drivers license is expiring in December and the lady at the DMV said I need at least the NOA of the I-360 to renew.
any suggestions on what I should do, how to get a copy of the NOA

If you sent the wrong dated I-360 forms, they may already rejected your I-360 and since your P.O Box zip code is wrong, Usps may have also sent the rejection notice back to Vermont.... At this point you can contact your congressperson to get an inquired or an update on your case if it was rejected or accepted (which I doubt was accepted if the forms were the old ones) after that you may file a new I-360 package with the correct update forms and the P.O BOX correct zip code.

I sent old forms for I-485 and the EAD. Those I got back and re-sent in July. the I-360 was current form date. I’ve done my fingerprint appointment so I’m guessing they have my I-360. I’ll contact the congressperson to see if they can help!

thank you!

Got it, yes 6 months is a long time for a I-360 Receipt not to be on hand. Make the inquiry with congress person.

If your l485 was denied because they think was a fraudulent marriage then your new AOS will be denied again.USCIS will have access to your previous l485.The BIA and several Court of Appeals had decisions regarding fraudulent marriage and the second AOS was denied because of the USCIS finding. You might have the VAWA Approved but the chance to have the AOS approved is almost non existent.

We had a visa journey member that uscis denied his first AOS,because they believed was a fraudulent marriage ,he filed Vawa 3 times and they denied 3 times because of  the fraud allegation. He was able to prove abuse but not not bonafide marriage .
