Yes you can push for a motion to reconsider! You're eligible as you're married to a citizen but you need to give them that proof! They have the copy in the i485 file...your attorney should be giving you sound legal advice about ways to obtain that document..hopefully the attorney we have here will see your post and give you substantial advice as she's very experienced in this field! Wasn't aware your i360 was denied..did they give any reason?😕

Ok so usually when they receive it, they will update that they have gotten your response and will begin working on your case again probably 2/3days after they receive it! Generally people get approvals 30-90 days after RFE response! I asked when you applied to know if it's just a request for initial evidence or additional evidence (usually requested when they have begun proper adjudication of the case) but the initial evidence is just to ensure you meet the requirements👍

Hey , I applied in April 2018. They requested my record from the police shortly when I applied. Then I got the work permit ,2 prima facie etc

Do you know his A#? Do you have any USCIS paperwork with his info on it? Did you use an attny for the family based petition one that may have copies of stuff> ?

 

As a last resort when a VAWA applicant does not have proof of status for the abuser they can send a letter explaining such and ask USCIS to check their records for the information.(name search) This can add some time to the overall process. Provide as much info as you can- including his name, DOB, place of entry, dates of adjustment/date of naturalization, A#, previous 130 NOA , etc etc. The more info you can give them the quicker it will be for them to find him in the system.

Ok..looks like they have started working on your case..hopefully you are approved soonest!🙏 we've seen mostly Jan, Feb and March 2018 approvals here..someone mentioned Apr 2018 as well from another site..here's wishing you all the best!👍

They said there wasn't enough evidence and suspect of fraud. He has a child from another woman before he married me and he had put his name on her leasing agreement because they require a certain level of income and hers wasn't enough. We responded why he did that but they said that his word doesn't have much value because he put his name on the lease when he wasn't living there so he has a potential to lie or something like that. We appealed to Board of appeals and they said that we can file motion to reopen with uscis. Through out this whole process (6 years), I was really miserable and I cant live another day with him. I talked to a lawyer she told me about vawa.

Sometimes USCIS Is messy, My Lawyer got Original EAD approval receipt,  but I received my EAD card at my address...... You can use your address too,  but Vermont may sent it to the your lawyers address which they have as the save address on file.

With what you said above . Was it your I-485 that was denied based on fraud ? And then a lawyer told you of vawa ?

Looks like a hot mess! You really need an attorney..not just any one..a brilliant one..that can call forth a miracle! If your intentions are true it will be ok..don't worry too much! Let an attorney handle your case..you might want to talk to someone privately..so you don't be all over the place! @sandranj 🙏🙏🙏

You did not provide enough evidences to proof abuse? How they suspected it a marriage fraud?

My lawyer sent my EAD renewal 2 weeks ago and I still haven’t received anything in the mail. Am I supposed to receive anything by mail or not? This is my first time sending for a renewal, so I don’t know if I should be receiving a letter by mail or not. 

 

Also, another question - if I want to travel with my combo card, will that affect my renewal or not? Do I have to wait to receive new card or I can travel internationally?

You should receive you receipts by mail within 3-4 weeks from sending your renewal application ? Did you file it before your card expires ? 

if your combo card still valid you can use it for traveling it won’t affect your renewal but make sure you come back to the states before it expires .. but if it’s expired you shouldn’t travel and should wait until you receive your new card
