Hi, this is my first time here. I want to file for vawa but my lawyer tells me that I have to prove my spouse is a U.S. Citizen. Initially, when he filed family petition for me, he had submitted a copy of his naturalization certificate but now that we are not together I don't have access to his certificate. He is also not willing to give me a copy. would this be a reason for them to deny me? would they be able to retrieve it from my previous application to Uscis? How do I need to go about this? Thanks.

There are certain other ways to obtain your spouse citizenship status. do you have any copy of the family petition file that you submitted previously?

USCIS is definitely able to retrieve it from the previously filed i485 like they did for my case! I have my i360 approved and wasn't asked at anytime to prove my spouse is a USC! Rest easy..you can also obtain a copy of his birth certificate or voters record..someone here has done that successfully..this is just to let you know..it's within your control, nothing to get anxious about!😊👍

I just got an RFE requesting for my marriage certificate. How long does it take to hear from USCIS after sending the document? I have 2 prima facie already.

Let's start from the beginning..when did you apply for i360? Ok so usually when they receive it, they will update that they have gotten your response and will begin working on your case again probably 2/3days after they receive it! Generally people get approvals 30-90 days after RFE response! I asked when you applied to know if it's just a request for initial evidence or additional evidence (usually requested when they have begun proper adjudication of the case) but the initial evidence is just to ensure you meet the requirements👍

Hello, 

I have a question. Applied for vawa about 6 months ago but never got a receipt. I have to re-send the other forms because I used old ones and I saw they had the zip code for my pobox wrong. So I’ve been sending them notarized letters asking for a copy of the I-360 NOA and any notices related to that application (PF, RFE) but I never heard anything back from them. I’ve sent about 3 letters so far and nothing. My drivers license is expiring in December and the lady at the DMV said I need at least the NOA of the I-360 to renew. 
any suggestions on what I should do, how to get a copy of the NOA

08/2017 - Married USC

09/2017 - Application for I-485, I-765, I-131

12/2017 - Approval  I-765, I-131

09/2018 Renewal application for I-765, I-131

04/2019 - I-485 interview scheduled 

04/2019 - I-485 denied, husband withdrew

05/2019 - Application for  I-360, I-485, I-765, I-131 

12/2019 EAD, AP approval

07/2020 EAD, AP renewal sent to Vermont

10/2020 EAD, AP Approval

11/2020 VAWA I-360 Approved (C31 produced)

01/2021 I-360 status changed to case approved

03/2021 - I-693 deficient notice from national benefit center

I dont have the copy of it. I asked uscis for a copy of all the files they have on my case and they sent me everything except some pages that were left blank because it was considered confidential which i guess included his citizenship certificate because I couldn't find it in the file they sent me.

Thank you! I did file my 1-360 and I-485 together initially but it got denied. They said I can do motion to reconsider or reopen but i dont want to do that because he is abusive towards me and I couldn't take it anymore. I wanted to file vawa by myself and I got a new lawyer and she is saying I have to get her a copy of his citizenship to file. Also, he got his citizenship through naturalization. His birth certificate is from another country. And I dont think he has ever voted. Should I just submit my case without it and see if they will request it or not?

May I ask why your I-360 was denied ?

I am filling out I-765 form for my work permit renewal and everything was smooth until I got to the following 27 queshion

27. Information About Your Eligibility Category
Refer to the Who May File Form
I-765 section of the Form I-765 Instructions to determine
the appropriate eligibility category for this application.
Enter the appropriate letter and number for your eligibility
category below (for example, (a)(8), (c)(17)(iii)).

 

Can I just skip it? Or what is my eligibility category? 

Do you guys remember what to fill in?

Do I put C-31 ??   as I my VAWA was approved and I am renewing c-31 category EAD card.

Make sense to me :)
