The initial l131 is free if the person submitted concurrently with form l485,if the person is submitting form l131 after the person submitted the AOS then the person has to pay uscis fees or to file the fee waiver .

Yes your attorney is correct ,he is not representing you in your l765 then he doesn’t need to give you form G28.

iam very confused now ! 

You can travel using your AP as long is valid and your l485 is still pending .Uscis sends the EAD C31 when the person checks the option in the form l360 to obtain work permit but you still can use your combo after receiving the new EAD category C31ok.

This is the reason your lawyer said you need to paid for I-131 fee. 

I-765 and I-131 are free when you initially paid

I-485 fee. or I-912 is approved for all forms.

 

I think if your lawyer will have sent it together with the package they will have waived it too, but since he did not you have to prove is for humanitarian reason to get the fee waive.

 

 

Despite they said the fee will be waived just in case of humanitarian parole I filed hundreds  of  l131 fee waivers and USCIS never denied to waive the fees , and I didn’t apply for humanitarian parole tho.

It seems your attorney doesn’t know enough about immigration law, if he doesn’t know something so simple like this I am concern how he handled your case .

I have another question.

My VAWA was approved on February 14 , 2019 and since then absolute silence.

I don't even know if they have transferred my case to the local office, my case statuses still say the same.... 

 What if I am not even in a queue for getting GC interview yet.

I've applied for my GC in October 2016 and I know that I will have to start a new waiting time which is from 10 -26 months at my local USISC. 

Should I ask local congressman to inquire on my behalf? Has anybody experienced something like that? 

Please let me know.

Definitely enlist the help of your congressman! Also bear in mind that not everyone gets notifications or alerts online...some folks just get the interview letter without any warning! For me I do get updates..my petition was approved in April and case was transferred in June..I received courtesy letter in July..currently waiting for a date for interview! That said, ask your congressman to inquire and know the status of your case! May I ask what your field office is please?

As far as I know, he knows his onions. He probably misread the instructions guiding form I-131 fee waiver. However, I can’t stop thinking that it was a ruse to charge me for having to submit another form on my behalf. 

That being said, what can I do to correct this mishandling? Should I ask him to send it soon because I need it, but I can’t pay the fee? I really have to go see my aging mother next as soon as possible.

 Needful to say, they  received my package on September 19th, 2019 and sent receipts to me on September 30th, 2019.

tell him to tried to send it the I-131 form with the Fee waiver if they waived good if not you may have to paid the fee. 😕 but it worth the try...
