Thank you.

But, it was denied. Does anyone know if there is any recourse for me? They did not give me a reason.

My attorney said its it’s only a diff category but work permit is a work permit.

So if it takes so long to get a new work permit under c31 and c09 was denied after vawa was approved, what can I do to expedite my EAD application?

Thank you.

Did you file correctly? One popular reason for USCIS to deny EAD is only when your AOS is approved and greencard sent out! Or they already issued an EAD under another category...But that is not the case with you...generally to expedite you must show proof of hardship..bank statements, letter from job, etc..at least that's how folks here have been doing it..I haven't done that before! Lastly enlist the help of your congressman they prove more useful than the so called attorneys!👍

Your questions is bit confusing, Your vawa case is approved or not? If is approve than you should apply for C31 category base on your approval if you did not requested when filling I-360 from.

'Usually USCIS does provide your a reason for a denial is on the NOA notice. Did you attorney provide you a copy?

Do you have a pending I-485..??

Thank you.

Sorry about the confusion. Vawa was recently approved in April 2019. Subsequently, my EAD category changed based on the I-765 application to c31 category as I filed for I-485, I-765 and I-360 application together. I was under c09 category before April 2019.

I have a pending I-485. I was not notified or given a copy about the reason for denial. Does it matter in the long run?

I’m just worried about what to do next and why I was not notified if the wait times under c31 category are significantly longer.

Thank you.

1. I-765 C09 is base on a pending I-485, if your I-485 is still pending no need for them to deny... (people received both EAD C09 and C31 they are different category) C31 Category is after Vawa approval is taking 18 - 23 months as now as it says on the processing time at USCIS.

2. Field Office is determine by your address,  you Mention Manhattan it will be at Federal Plaza.

Hope this help.

Thank you.

I’ll double check why why I was not notified.

Your attorney's address is not always the address that it turns out except it was indicated as such on the i485...your zip code is more reliable..use the USCIS office locator using your zip code! For example I live in Queens but my field office is Long Island..you can find out exactly through your congressperson...that's how I found out mines!💁

Thanks.

Dear your I-360 is approved did you received C31 EAD yet?? maybe this is the reason they denied C09 EAD because they already issue the C31 EAD......  Vermont Service Center recently are denying C09 EAD, if they already issue EAD under Vawa approval.... NO IDEA if this is a new thing.. I have two people I know with this, before they issue both EAD. I think there was someone in the forum with the same situation.

Precisely what I explained to namestynyc! It's two reasons! Greencard approval or EAD issued in another category! Otherwise faulty application...

I'll find out for sure through mine..as you're aware I've been issued a C31 and have a pending C9 renewal...I hope they don't intend to deny me..as they haven't said anything yet concerning the application..💁

Yes, you are correct as I told stillwinning. Your theory about denying c09 after issuing c31 when there is such a close timeline holds weight.

My c31 EAd expires in 2/2020 whereas the c09 expires in 3/2020. So, now my question is, if my last request for c09 based EAD was rejected, can I still apply for c09 now or am I only able to apply for EAD renewal under c31 category going forward?

I contacted a local non profit to learn more. The lady advised to get a copy of the denial notice and still file under c09 category now that my case has been transferred.

Great job getting to the bottom of the issue @FeDaniela and @stillwinning! Thanks a bunch.

I was in panic mode for a quick second. Lol

Thank you, But you also confuse us, you already got your EAD C31 on hand LOL this is a renewal... You can renew either C09 or C31 you qualify for both, but just renew under one category, Also after VAWA is approved the wait time for renewal EAD C31 is the same time as a C09. (5-8months)

Remember to sent it to Vermont Service Center.

I think you should be fine.

i think mine was an exception.

The lady I spoke to earlier advised to file under the c09 category.

Do you guys know with if it’s true that under certain categories like c09 based EAD once we receive the receipt notice, we can use that to show the employer we automatically get a 180 day extension in our work permit even if we don’t have the physical EAD card on hand yet?
