Thank you for the information, i still wondering why my lawyer told me they have to contact the USCIS to reopen my case ??

I-765 cancellation happens upon I-485 DENIAL, they wont just CANCEL I-485 just because you applied for I360 and are writing to them. Am I Right @sandranj

When you write to hold i-485, and they see that I-864 has been pulled, they will deny holding the application and deny the I-485. It is a challenge with holding it in writing  once you file VAWA as you have to see who has jurisdiction over I-485, and now you are a protected file, they won't talk to you over the phone.

makes sense. Good to know, I did not know this! 

 

however if: 

1. your spouse has not pulled I-130 or I-864?

2. you got the I-864 from someone other than spouse who will not be pulling it back

 

then that should take care of one of the two issues right?

Only your spouse can file I-864 as the primary person. No one else can file as primary. 

 

If they have not pulled it then you are fine.

When the case is put on hold the case is not closed, then he doesn't have anything to reopen.

Yes applying for fee waiver slows down the process. They will not accept your I-485 or anything else until fee waiver is approved. If fee waiver is denied, then you will have to re submit paperwork with payment. 

 I had numerous cases filed with a fee waiver and the petitioners got the receipts within 15/30 days and I have many cases the fees were paid and they got the receipt within 45/60 days,that being said a fee waiver doesn't slow down the process at all.

I just got home now and open my mailbox and I saw a mail from USCIS and my heart skipped . I just received my I-360 receipt. Now what next my friends ? 

 

By the way, it took me 14 days to get it in mail.  @Stillwinning!!!😊 you were right
