HEY,

MY ATTORNEY WANTS TO APPLY FOR FEE WAIVER FOR I-485. I ALREADY HAVE WORK PERMIT FROM MY DENIED I-485. IT'S GONNA EXPIRE AT START OF THIS YEAR.

APPLYING FEE WAIVER WON'T SLOW DOWN THE PROCESS OF GETTING NEW WP? I HAVE ALREADY SUBMITTED MY 360 A FEW MONTHS AGO.

I NEED YOUR HELP SINCE I AM GETTING A JOB OFFER.

Yes applying for fee waiver slows down the process. They will not accept your I-485 or anything else until fee waiver is approved. If fee waiver is denied, then you will have to re submit paperwork with payment.

Hello Guys,

Undelivered Combo Card

I need some advice. My combo card was approved in July  but sent to the wrong address so I never received it. USPS said is was returned to sender. I sent a notarized letter to USCIS for a replacement card or a return of the card which was sent back to them . I followed this up with a letter to my congressman. I received a letter  from USCIS stating that they have not received the returned card and that I would need to file a fresh application. This does not make sense since application has already been approved and after almost a year waiting for the card. Also they claim that I did not update my address but I did that more than 6 months ago and received an acknowledgement from USCIS. Please what's the best way to go about this? I do not want to lose my job.

Thank you.

You will have to file a I-90 to ask for replacement card. You can do that online. There is no fee but you will have to do biometrics again.

Good morning VJ Family i have a question, 30 days a go my I-360 got approved :) and i requested my lawyer to get in contact with USCIS and to reopen my I-485 since my I-485 was put on hold just before my interview for my green card. My question is how long after an approval on I-360 USCIS will scheduled  a interview and is it better if i reach out to them or  it will be better i contact my congressmen, the reason why im asking this is that my VAWA case toke 4 years and i'm hoping that it wont take them 2-3 years for that interview to be scheduled. I was married to a US citizen, can you guess please advice me and what to do???

If your case was put on hold then your attorney doesn’t have to contact USCIS because your case was not closed ,they will put your form l485 with the l360.Interview can take from 6 months to 18months.

@sandranj
I would appreciate if you can give me a comment on the below as you are experienced in VAWA and know much more then I do, please:

I am seeking information on the below.

So, I have pending I485 based on marriage and pending I360 (NOA1 24APR19, Fingerprint Review Completer 24MAY19).
I currently have EAD+AP which are going to be expired on 29NOV19 and I applied for an extension of both in July, so waiting (applied by my own, with no help from my lawyer because she was asking for more money)...

I have a lawyer ONLY on my I360 petition, all the steps before I took without a lawyer and she is not a lawyer on my I485 unless USCIS link it automatically.
Me and my lawyer sent in I360 before divorce was finalized, so divorce decree was not included in the application.
I want to send it in now and curious if I can do so by my own or only my lawyer can do so if I have her on file for I360? Will USCIS accept communication from me or only from her?  (also I want to request my lawyer for a copy of I360 application she sent in because only she knows what she included from everything I provided to her and to check if I need to include anything else except of Divorce Decree).

Another question is about my I485 pending application:
So, in July my case status changed to "Ready to be scheduled for an interview" but I just moved in June and I did submit address change as required, but never got a confirmation of address change, so as soon as I saw new I485 status I enquired help from Congressman Local Office (as VJ members advised, thank you for that) and got feedback that USCIS has my new address, it is updated and interview will be scheduled at my new local office, but wait time in this area is longer, so it will take at least 6 more months to schedule it.
Now the question is: Should I submit a request to hold in abeyance until my I360 is adjudicated or not? Again...can I request that or I am not authorised to do such requests and only my lawyer can do so?

Thank you!

@sandranj has always said . You should go for the interview and tell the officer to kindly place your I-485 on hold until vawa is adjudicated . And if in the event it’s not held and cancelled, that’s means any I-765 linked to the I-485 is cancelled too. If that happens, then file a new I-485 and I-765. To answer, your question. You don’t need to submit a request to hold in abeyance, just wait until the date of the interview is scheduled for you .

We can write to hold I485 in abeyance, why not?  chances are that USCIS will be glitchy and we are still called in for the interview and so on but no harm in writing to them and sending I360 receipt along.

I-765 cancellation happens upon I-485 DENIAL, they wont just CANCEL I-485 just because you applied for I360 and are writing to them. Am I Right @sandranj

My divorce has been finalized after my I360 but I did not submitted my divorce decree to USCIS/VSC yet. I think it is needed during AOS interview.

-Also, if you have your AOS interview, you can tell IO to hold your AOS until your I360 has been approved.
