Oh thats crazy! Your attorney is ... How the hell he can include your abuser address in your petition? You can always write a letter to vsc and ask them to change your address.. also, please write a detailed statement and add all the remaining evidences. Attach i360 form copy as a reference since you dont have receipt yet

It goes to the local office, there should be instructions on the letter of where to send info

Tracking the card, it says that is now on its way to its final destinations in Newark ,where my lawyer have his office.

please share your time line and do you got any RFE how you prove the abuse do you have any police report or a restraining order

If you received an RFE regarding the first case then you will  receive for the second VAWA as well. You lived in the U.S then you have to submit a police clearance from all places you  lived in the U.S for six or more months during the 3 years preceding the VAWA petition. For example if you lived in Houston, Texas  in 2015 for 7 months and in Dallas for 5 months then you need just the police clearance from Houston, but if you lived in Houston and Dallas for over 6 months then  you must submit police clearance from both places.

I lived in Russia always, in the USA I lived 3 months and 5.5 months in different years of 2017 and 2019

Why did USCIS deny your I-485? if it's because you didn't appear to attend the interview with your husband or because they asked more evidences of a bonafide marriage and they were not satisfied with they received from you then you won't have any problem filing a new I-485, but if USCIS mentioned that they denied your I485 because of a sham/fraudulent  marriage then you won't ever get a green card here. In both cases you will receive a notice to appear in Court.  

 

I advise you to refile a new I-485, if they didn't state about a sham/fraudulent marriage, and as soon you get the VAWA/AOS receipt submit a copy of the receipt to the place that denied your case and ask them not to issue the NTA considering that you filed I-360 and I-485.

It's not normal at all.I can understand  for example if you are in the U.S and ask your family and friends to mail you using Fedex. Fedex is  expensive and it's ok for you to send  them the money to pay  for the Fedex,  but to charge you to write a letter is too much my dear.

It's up to you, but It's advised to bring an  attorney if you were arrested, or had an asylum case in the past or got married several times before etc...

I have found the courage to get sign up and seek guidance for my current situation.

I got married to my US citizen wife in October 2017. By June 2018 she was 3 months pregnant and 

regularly tried to start fights with me but I always avoided that problem. The last time she had me trapped

in the house and refused to let me go to work. When I was finally able to escape, I stayed away a 2 days,

when I returned she would not let me in the house but threw my stuff at me and she held on to my

She proceeded to clean out our joint account and subsequently closed it and also removed my name from

all utility bills. 

 

My attempts at peace failed, so I gave up. Then, one day in September 2018 she

emailed me saying she knew my interview would come up soon and she knows how important it is to me

and she is willing to go with me. Shortly after that, I received invitation for the interview to hold by Nov., 1 2018.

We had to reopen a fresh bank account and she had to put my name back on the utility bills et al. 

Things became strange when she refused to attach the sonogram and other documents to indicate that she

is pregnant. On the day of the interview, she seized my wedding band but I quietly drove to the mall and got

another one. While my attorney prepared us with likely interview questions and asked if we'd talk about children

she denied saying she doesnt want any kids. The interview went well and I was told my case will be reviewed.

 

On our way back, she started to trouble me again but I stayed calm. The following days, she called me a common

immigrant and all kind of names deliberately to provoke me, so I stayed away. Five (5) weeks after the interview,

she withdrew her petition for me and in February of this year a denial letter was sent. She told USCIS that I have

left home and she doesnt know where I am. She went ahead again to close our joint account. She gave birth to

our daughter in January and she switched hospitals to make sure my name is not on the birth certificate. Right now,

I filed for access and have a PL court order that gives

me  that.

 

Now, my problem is this. I have met a number of attorneys and they are not willing to take up my case to file for VAWA.

They always say that because she did not hit me, it will be hard to prove abuse (even though I already seen

a Psychiatrist who believes I was abused) and I have had multiple therapy sessions because I was in a really bad

shape mentally. In fact, this last attorney told me that applying for VAWA could trigger a NOTICE TO APPEAR (NTA).

 

Please what can I do?

 

 

There is a big difference between abuse an unpleasant marriage.Here you mentioned she called you names and cleaned the bank account.Just to call someone names won't have your VAWA approved, if she withdrew for example $10k or more you might have a chance to argue about  financial abuse, despite is tough to prove financial abuse.  It's hard to say if you have a VAWA case or not, maybe you are not mentioning here all psychological abused suffered.The person doesn't  need to suffer physical abuse to file VAWA.

today I received the automatic renewal from Prima Facie (thank you God because I use it to study) and it has more 180 days and it says that I should not receive an decision before that?

 

what do you guys think about it? One of you have received a 180 days prima facie and had the case approved before that?

 

receiving the Prima Facie renewal (issued couple days ago) is a good thing? Like meaning that they are still working on my case? Or getting the 180 is a bad signal?

 

please let me know your thoughts

Prima facie does not mean a good or bad thing, it means you can apply for FAFSA,Medicaid,and in some States to apply for food stamps.

We did not appear for the first interview becuse he hit me few days to the interview, I got muscle strain in the neck, I went to the hospital a day before the first interview. I called my former attorney to help me get an interview reschedule but unfortunately the new date was sent to my old address, which I never received but was stated in the denial letter which was also mailed to the old address, it was one of my former neighbors that went to the old address and saw the letter 20 days the delivery date
