I believe that once your VAWA is approved they send you the approval letter alongside the deffered action notice to give you time to adjust status..note this is based on an approved i360! If your i485 was denied, you can either file a new one one or appeal/file a motion to reconsider-reopen! So the deffered action applies to everyone whose i360 has been approved regardless I believe!πŸ’

My I-485 was denied before I filed VAWA. As it is now, I think I might receive a Notice to appear.Β

Hello my Dears

I received a request for evidence.

Β 

Only it:

X - Evidence you are a person of good, moral charater(generally, the Service requests police clearances from each locality in which you have lived for at least 6 months during the past Β three years.

Β 

RFE -Β This is a request for Petition 1, which I wrote them a letter to cancel.

They received my letter requesting the cancellation of Petition 1, but I do not know (not sure) that they canceled it or not?

Maybe I should give them what they ask. And indicate again that I have a different case number ...

Β 

What should be included in this answer?Β I already sent a police note in the first letter.

It's probably not cancelled! So i'ld say..send the response..it's safer than ignoring it! You should accompany the RFE response with a detailed letter advising USCIS of your intent to cancel one of the petitions, let them know you already sent out a letter earlier asking them to cancel..you may even attach a copy of the letter! As said here a thousand times, USCIS can be messy! But we don't want to take chances!πŸ’

Usually for good moral character we're required to proof we areΒ law abiding/good citizens! So that's where the police report comes into play! You can also get letters from friends and family..church or any social organization you may belong to-reiterating you are a person of good conduct and all that..πŸ‘

You're welcome dear..also I'm sure sandra can intimate you on the legal implication of the previously denied i485 in the light of the current petition!Β You should read previous threads..so many circumstances like yours..and how it resolved/worked out..it may seem like too much work, but absolutely worth it!πŸ‘
