Hello Guys,

 

Undelivered Combo Card 

 

I need some advice. My combo card was approved in July  but sent to the wrong address so I never received it. USPS said is was returned to sender. I sent a notarized letter to USCIS for a replacement card or a return of the card which was sent back to them . I followed this up with a letter to my congressman. I received a letter  from USCIS stating that they have not received the returned card and that I would need to file a fresh application. This does not make sense since application has already been approved and after almost a year waiting for the card. Also they claim that I did not update my address but I did that more than 6 months ago and received an acknowledgement from USCIS. Please what's the best way to go about this? I do not want to lose my job.

I want to send it in now and curious if I can do so by my own or only my lawyer can do so if I have her on file for I360? Will USCIS accept communication from me or only from her?  (also I want to request my lawyer for a copy of I360 application she sent in because only she knows what she included from everything I provided to her and to check if I need to include anything else except of Divorce Decree).

Another question is about my I485 pending application:
So, in July my case status changed to "Ready to be scheduled for an interview" but I just moved in June and I did submit address change as required, but never got a confirmation of address change, so as soon as I saw new I485 status I enquired help from Congressman Local Office (as VJ members advised, thank you for that) and got feedback that USCIS has my new address, it is updated and interview will be scheduled at my new local office, but wait time in this area is longer, so it will take at least 6 more months to schedule it. 
Now the question is: Should I submit a request to hold in abeyance until my I360 is adjudicated or not? Again...can I request that or I am not authorised to do such requests and only my lawyer can do so? 

Please assist as you have more experience and knowledge!

You will have to attend interview to ask the officer to put your I485 in hold until Vawa is approved.

Once that happens you always keep a copy of your divorce decree, they have been asking for in the interview so you can hande it to the officer in case they ask.

You don’t need to have a lawyer near by, I had mine from another State. 

The lawyer has to be specialize in Vawa. It would be best!

No, you don’t need your lawyer to be in same state. I only suggested as you are expressing distrust in your lawyer and going through challenges getting her to file things for you.

Ask your lawyer for help. I am sure there are many more details in your case that we don’t know here in a public forum. You will be ok in the end. Don’t panic

Rfe may 15

My lawyer never received The rfe letter as they said,,, they requested again. It took about 2 months to received,

I was really sad,, they ask for good faith bonafide, 

Uscis received my response August 9 

6 day before 15 may uffff .

Yesterday night i saw card is being produced,  thank god.

Good morning VJ Family i have a question, 30 days a go my I-360 got approved :) and i requested my lawyer to get in contact with USCIS and to reopen my I-485 since my I-485 was put on hold just before my interview for my green card. My question is how long after an approval on I-360 USCIS will scheduled  a interview and is it better if i reach out to them or  it will be better i contact my congressmen, the reason why im asking this is that my VAWA case toke 4 years and i'm hoping that it wont take them 2-3 years for that interview to be scheduled. I was married to a US citizen, can you guess please advice me and what to do???

they will transfer your I-485 to your local field office. It varies how ling they take for this step, I have seen here cases that ranged from 2-6 months. Then after that how quickly they schedule your interview also depends... there is no set trend really, its all over the place as of now.  In the meantime, live your life, rejoice that one huge step is done! 

 

I cant even imagine what you went through waiting for 4 years. Hope the next part is over in the blink of an eye and you get your life completely back with I485 approval. 🤗

4 years for approval? Im still waiting for my interview after vawa approval. its now going to be 12 months of waiting and nothing!

Thank you i will try and yeah it was a unforgettably journey, hopefully with a positive outcome at the end. Also doe it make a difference if you are marred to a Green Card Holder or to a US Citizen
