Hello my Vawa family, it’s been a while since I posted. I was busy preparing my RFE, which was for good faith marriage. As I stated before, my abuser and I had a joint account but that account was closed shortly after our marriage because he overdraft it and it was supposed to be our savings account. So USCIS said they need more evidence. They also stated that my original affidavit didn’t have enough details about our courtship and marriage.Β

Β

I rewrote my affidavit about 17 pagesΒ detailing about when we first met, our courtship, when he met my family, when I met his family, our engagement, our wedding dayΒ and our marriage. I put all the details in it. I got 3 affidavits from my family who knew about the marriage. I also included text messages from him and I when he used to Confess his love to me. USCIS got it today so I am asking for prayers so I can get an approval soon. It’s been a long and painful journey. Thank you to everyone on this forum who take their time and explain things to those of us who need help. I am praying for everyone single one of us here. May we all get good news at the end of this journey.Β

Praying for you honey. We are all in that waitingΒ  boat. When did you file vawa?

Hi ,

No,i have not submitted my I-485..

It's not too late! Like you've been adviced by many here..if your spouse is a USC, you can ask your attorney to file the i485 and i765 C9 category! That's the way you can get the much needed work permit before your VAWA is approved! If you don't..then you'll only get C31 EAD after your VAWA approval! Did I mention it takes time...πŸ’

Previously most attorneys choseΒ to file i360 only and wait for approval because they feel that the case is not strong enough, and that if it is denied, you may not be put in removal proceedings..but it is NOT so! In the event that it is denied, you will still be put in removal proceedings! And the rest just do so hoping to charge you seperately when the time is right! I'll tell you right now, there's no reason you shouldn't file concurrently! It's your case..your life..your call! Put your foot down and tell him you want to file the i485 and i765. You need to put pressure on him and make him see how desperately you need to start working! If you're too soft with them..they take you for a ride!πŸ’

In that case - if your I485 is denied, do you apply for I360 and I765 under C09 or C31 category?

I-765 category is solely base on the application your applying under. Vawa (I-360) will always be C31,Β I-485 C9, Deferred actionΒ C14, DACA C33Β Etc...Β
