I don’t understand that either, my

prima facia letter came on on 20 May 2019, there hasn’t been any update, and we are submitting green card application, ead  and travel documents application, I am

just if that’s the process, or if it doesn’t work like that? Any insights, would be very

much appreciated.

thanks

So you have I-360 not I130.

now you need to submit I485, I765 and I131. I believe that your spouse /Ex is a USC.

The Prima facie is means you established the minimum requirements for VAWA and you can use that for public benefits.

But there is no EAD based on that.

Maybe you are confusion I-130 form which is a family petition with Adjustment of status package which is I-485 / I-765 (EAD) / I-131 AP.  Since you already file I-360 and received your prima facie.

I-360 (Vawa) is taking from 18-23 months to be approved after receiving Prima Facie you have to wait months to view any updates, RFE or approval, the process is a bit long please have patients they are working on late 2017 case and earliest 2018 case latest approval we have seen is May 2018.

If you want to keep the second l360 that you submitted  then answer the RFE saying that you want to withdraw the self petition form l360 because you filed a new Vawa petition, and submit a copy of the second l360 in order for them to see that you filed a new one, but don’t forget to put in the letter THE NUMBER OF THE FIRST I360 that you want to withdraw, and submit the RFE along with the letter.

I wrote a letter requesting to cancel 1 petition
Response to requests for additional evidence on 1 petition
I didn’t receive it in the mail, I just saw it in my account
I don’t know how to do it better ...
I don’t know what kind of requests they ask, I haven’t received a letter yet.
I do not know should I be responsible for their requests? (1 petition)
I don’t know if they will cancel it when I wrote a letter
2 Petition, there is simply a letter that it has been received, but so far the petition is proceeding 1.

What I should doing?

Thank you dear, that helps, it means it’s going to be awhile before I get any response from them and be able

to travel anywhere.!

Does that mean I have to pay the fees for both 1485 and I765 all over again?

Yes you have to paid the fee, but you can apply your new I-485 / I-765 with fee waiver form I-912 so you don't have to paid.... I suggest you do it asap since I-912 form will be update on December 2nd, 2019, and no means tested benefits (Person who received any type of government benefits such as medicaid, food stamps, SSI ect)  will be accepted and more requirements will be implemented.

on I-360 yes you have to wait until they work on your case, but if you apply for I-485 along with work permit and travel document you don't need to wait for I-360 approval, you will be able to work and travel.... Just need to file AOS package. Since your abuser was US citizens.
