Yes it's indicated therein. Not everyone gets the NOA and PF simultaneously. You probably might get it soon as they do an initial check of your documents. It basically says..a prima facie determination has been established on your case...it just means that your supporting documents meet the requirements to qualify for VAWA.

Thank you. I also did not know what PF.

I don’t know whether they will send me or not. I still can’t recover in any way, and possibly because of these experiences, although I understand that it takes time.

I know it’s super late, but I can’t sleep right now. What website you’re using to check the status of your case? I just went back in Part 11 and someone mentioned the myaccount@USCIS.dhs.gov of which I never heard of. I signed up and it shows that as of yesterday β€œNew Card is being produced”. I can’t let myself be happy yet as I am confused, I don’t know if this site is legit, as on my other USCIS account it doesn’t show any activity after the interview . Anyone who uses it, can you please put my doubts at rest? OMG! Please make it be true.

they both are correct. it means your Vawa has been approved if it is a case status of your vawa :-)Β

Oh ok..glad you do now. Thank God you got a receipt for now, maybe when an officer goes through all your documents, they'll either send you a PF or initial request for evidence. Let's hope and pray!πŸ™

@Stillwinning!!!😊 have you used this website at all? I don’t know what to believe. I guess they might be working onΒ the case, but it’s confusing, because now they show: Oct. 28: we ordered your new card; oct. 29: we ordered your new card; oct. 30: we completed your fingerprints review.Β

its an approval. Congratulations :-)Β

That’s confusing and contradictory. What of people that never received a PF at all and got Approved ? Or you’re saying if one does not meet the requirements they don’t receive PF Β ?Β

I met on FB
with a woman who also asked for help
I'm tired of hearing such bullying.
These bullying are not physical (in her words)
They also had no marriage
I don’t know how to help her.
She is crying and upset. And seeks advice

does she live here? if they are not married, she cannot qualify for vawa-Β

there are people who never received PF but got approved. PF is a document which shows that all the necessary evidences are provided to USCIS but you can still receive RFE from them at any time during your petition. if one does not meet the requirement, USCIS ask for more documents within 2 - 3 months after submitting vawa petition

For your case especially..you need to write an in-depth affidavit from the moment you met your ex through when the horrors started and then when you split. ( This is incase you get an RFE) whatever further documents you submit, accompany it with the detailed affidavit!Β Sometimes your personal affidavit is your saving grace! Pour out your heart.πŸ‘

Yes. You can use previous evidence since they did happen during your marriage, even before AOS.Β

AOS is toΒ legalized your status in USA, but your marriage is valid the date you entered in it.Β Also the USCIS website, said you can submit any credible evidence relevant to your applicationΒ if seeking to remove condition on a waiver base battered or subjected to extreme cruelty. The evidence you may not sent of abuse if they happened before you were married, this ones will not be valid or relevant to USCIS.Β

Β

If you are filing a waiver of the joint filing requirement because you and/or your conditional resident child were battered or subjected to extreme cruelty, did you provide the following?

  • NOTE:Β With respect to abuse waivers, you may file your form with any credible evidence relevant to the application. The determination of what evidence is credible and the weight to be given is within the sole discretion of USCIS.
  • Copies of the front and back of your Permanent Resident CardΒ
  • Copies of the front and back of the Permanent Resident Cards of any conditional resident children you are including in your petition (if applicable)
  • Evidence of the relationship
  • Submit copies of documents indicating that the marriage upon which you were granted status was entered in good faith and was not for the purpose of circumventing immigration laws. Submit copies of as many documents as you can to establish this fact, to demonstrate the circumstances of the relationship from the date of the marriage to the present date.Β
  • Evidence of abuse
  • Your final divorce or annulment decree if your marriage was terminated by divorce on grounds of physical abuse or extreme cruelty
  • An explanation for the reason you are filing separately from your primary conditional permanent resident parent (if applicable)
  • Dispositions on criminal charges, arrests, or convictions (if applicable)

Β

You may also be able to apply for I-751 to remove your green card condition early kindly read thisΒ
