Hey dear..

You will need to provide as many details andΒ specific instancesΒ of your spouse’s abusive actions and how these actions hurt you and controlled your life. It can be painful and emotionally difficult to recount instances of this behavior, but it is necessary in order to convince USCIS to grant you a waiver.

You will need evidence to prove that you were a victim of domestic violence, so you should ideally provide more than just a personal statement. Official reports from police and medical personnel, medical records and photographs of injuries, and affidavits from social workers and school officials are excellent forms of evidence. You can also submit affidavits from others who can describe instances of abuse and battering that your spouse inflicted upon you.

So basically the Detailed Β pyschologist evaluation and my DV shelter record and DV advocate letter and the doctor who assessed my injuries - all these are basically waste ? they are all dated back in pastΒ
can’t use any of them ?Β

Nothing is wasted gather all you have...from past and present. There should be a history of the abuse you suffered..get statements from witnesses..take your time and gather what you can..you cannot give what you don't have..πŸ’

Β I was in a abusive marriage but I truly loved the man and I hoped things would work out . So like a true abuse cycle I kept going on with the relationship as he kept promising he would change . I had contemplated filing vawa long back and collected evidence of abuse ( Some letters from DV advocates pyschologist letter , letter from a doctor treating ) but I never got to file the vawa as my abuser brainwashed me into giving marriage a second chance .Β Fast forward we went to AOS interview togetherΒ have a approved conditional green card , however I don’t see the marriage lasting till the end of the 2 year where removal of conditions need to be filed. I fear further abuse as now I am further more dependable on him especially with the conditional GC and need him to ROC ( removal of conditions )Β
What are my options ? Can I file Β a ROC using abuse waiver ? I need more info on that ... will my old evidences of abuse help in that abuse waiver ?Β

I made a mistake of not filing VAWA back then I want to take the right steps nowΒ

You can file for divorce waiver or extreme cruelty waiver.Β

Hello,

Β

As some of you may know VAWA case was approved this year and I am about to file I-485.:)

It took them 2 years to approve my case......  certainly a  long and doubtful time for me .....😐

I was't even sure that it will be approved as I've thought that my abuse evidences weren't that strong. 😩

Today I want to share with youΒ this resource, I've found, which helped me a lot and might help you in your VAWA journey.

I know it’s super late, but I can’t sleep right now. What website you’re using to check the status of your case? I just went back in Part 11 and someone mentioned the myaccount@USCIS.dhs.gov of which I never heard of. I signed up and it shows that as of yesterday β€œNew Card is being produced”. I can’t let myself be happy yet as I am confused, I don’t know if this site is legit, as on my other USCIS account it doesn’t show any activity after the interview . Anyone who uses it, can you please put my doubts at rest? OMG! Please make it be true.

This sounds like great news.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

There's no set number to be received, and no particular order...all depends on the officer and which heΒ believes is appropriate at each point in time. My last prima facie was valid for 180days and was still valid long after my i360 was approved early this year.

@Stillwinning!!!😊 have you used this website at all? I don’t know what to believe. I guess they might be working onΒ the case, but it’s confusing, because now they show: Oct. 28: we ordered your new card; oct. 29: we ordered your new card; oct. 30: we completed your fingerprints review.Β
