I have a question. I just got my biometrics done and it's been updated in the online portal. The i485, i360 and work permit were filed concurrently. I haven't been able to get a straight answer but will I receive my work permit before or after i360 approval? I've seen conflicting answers

Β

I can confirm. I take the plane for in state flights. I use my foreign passport and I get across fine no problems

If you have filed your i765 based on c09, you will get it within 3 months. If you filed it on c31, you have to wait till your vawa gets approved πŸ™‚

Ok so you will be able to get a C9 EAD if your spouse is a USC before your i360 is decided! Then when your i360 gets approved, you'll be getting the C31 EAD!Β

What are the risks to travel by plane inside the US and get hold by ice...

My dear,..this is Trump's administration..my sisterly and sincere advice to you would be; carry your relevant documents with you each time you want to make a trip! Nobody says you will be detained..but there's a saying that "Better safe than sorry"! I believe a word is enough for the wise!πŸ˜ŠπŸ‘

Just to not make things confused.Β I did not write that in my cover letter.Β

The Form AR-11 has a question β€œΒ I am in the United States as a β€œ

Β

that’s where I wroteΒ

Β

NO LAWFUL STATUS.

Β

Not in the cover letter. I believe Nonimmigrant is also ok.

If the person has for example a B2 expired then the person should put " B2 visa expired.

..."pending i360"..yours is approved already! Mine's approved too..does this make any difference? Being that they sent me an email to confirm my address has been updated and case redirected to current field office? Usually they are very discreet concerning VAWA related petitions..pending or approved!

USCIS usually doesΒ not confirm if they updated the address or not, Β but Β they areΒ messy Β then sometimes people receivedΒ information from them that they updatedΒ the address, but in the VAWA Law guidelines there is no requirement Β that USCIS must inform the petitioner in written or the attorney if theyΒ updated Β the address.

I see, I don’t know why the Officer confirmed that to me on the phone if he was not supposed to do.Β I could hear when he wasΒ reading about my all case in his computer lol. I was going to Info-pass but he told me what I wanted to know.

Β

yes,Β theΒ rule is they won’t tell you anything about VAWA related cases.Β

Β

@dreamer1Β And to change the address for i360Β i485 just send Form AR-11 with a cover letter and copy of receipts to VSC.

Ok....I didn’t include the G28, so i’ll Wait either for a denial letter or a RFE. They received my I765 on august 20 and on september 4th they updated the online notice that they reviewed the fingerprints and will assign it to an officer to work on it. So we can determine at what stage in the application they realize they need an attorney appearance.Β

Who must submit the G28 is JUST THE ATTORNEY representing you, if you don't have an attorney representingΒ you then you don't have to file form G28.Β G28 is a Notice of Entry of Appearance as Attorney or Accredited Representative.

EAD category C9 is taking Β around 8/9 months. I would say just 2% got the EAD Β within 3 months.

I do have an attorney though, but i filed on my own to save some money. What are the chances for theΒ to application to be rejected? I still indicated my attorney's address for all correspondence. The reason i am asking now is because the checks was cashed... so if it gets rejected, it means no refund.Β

She has an attorney..but you know the drill with these clueless attorneys..so she wants to switch things up a little bit and send stuff herself using the g-28 from the attorney..it will be as though the attorney is sending it out..only this time to the right place!πŸ’πŸ˜Š
