NVC says interview will be granted for my wife, but sponsor doesn't meet income requirements.

So my wife got notified by NVC that the Consulate will be contacting her to schedule interview, but we also got a 2nd notification that the sponsor does not meet the financial requirements. 

 

I am assuming because my income was earned overseas, it does not qualify, even though the last 3 years of tax filings had me well over the 125% poverty level.

 

My question is....If I tranfer money to my local bank in the USA to put my cash assets to 65k, which would be 3 times over the poverty limit for my wife and I, would this be suffice to meet the financial requirements?  I will be moving home with my wife. I am a US citizen.

 

Do I need to submit an 864a or some other document along with the bank statement to NVS? Or do I have my wife take this to the interview? The notification stated that the Consular officer will be making the final decision.

 

Any feedback concerning this matter is greatly appreciated.

Overseas income will not be counted unless it will continue from the same source upon return to the US (i.e. a job transfer within the same company or self-employment income that will remain uninterrupted).

 

Assets can be used in lieu of - or combination with - income. As you noted, it's a 3x ratio for the spouse of a USC. That said, $65k is barely above the bare minimum for consideration. Under = no visa. Over = judgement call by the CO based upon a totality of the circumstances.

An updated I-864 can be brought to the interview. No I-864A needed...just the updated I-864 packet + documentation of the assets (i.e. 12 months of bank statements).

Your assets are declared on your I-864 with no need for another I-864a

Thank you very much answering my question.  I do have a follow-up question. 

 

I need to have over 65k for my i864 to be financially adequate for my wife and myself. I am going to send another 25k to my USA bank account which would put me over 50k, and was thinking that my parents would loan me another 20k to put me over 70k. I would have this amount in an updated i864 for my wife to take to the interview. Would this be suffice and ok for meeting the financial requirements when my wife goes for the interview? Will there be any issues if I did this to meet the financial requirements? I should have another 10k in my local overseas bank account as well by the time of interview.  Thanks again for the feedback.

This won't work. COs look for things just like this (family members or friends putting money into one's account for immigration purposes). Generally they want to see the money in the account for at least a year, unless there is a reason for a sudden deposit (i.e. insurance claim, inheritance, etc.).

So it seems the only way to get this approved would be to get a joint sponsor. Do I need to submit that to the NVS or would my wife take this to the interview?

 

Would it be possible to postpone interview until I have 65k in total between my overseas account and my local USA account? About 2-3 months.

For a joint sponsor, the I-864 would be presented at the interview at this point. Normally it's provided at NVC, but they already granted an interview, so take the I-864 packet to the interview.

Yes, you can generally delay for up to a year easily. The I-130 itself does not expire (but they will return after a year and eventually dispose of it).
