Applied for K1 Visa for my Fiancee.

Hi, I petition my fiancee for k1 visa through the Bogota Embassy. She is from Venezuela with both Venezuelan and Spanish passport. 

She used to come to the U.S on an ESTA but it was revoked a year ago. We also have a son who was born here in the United States in 2014. We just found out the she over stayed one day when our son was born. she is stayed for 91 days. Would this cause a problem during the interview? and how long does it take to get the package from the embassy for next steps before the interview? our case got approved almost two months ago.

The overstay makes her ineligible for the VWP, as you have learned, but only 1 day of overstay is not an issue for an immigrant visa. The bars start at 180 days of overstay.

She having a overstay of only 1 day is insignificant and does not matter for family based immigration
