Hi,

I was wondering, if we applied for IR1 at the time when we were married less than 2 years, but actually got the green card after interview when we are married more than 2 years,
Do we get the 10 year green card or the 2 year conditional one?

Thanks.

10.  It is the age of the marriage upon entry

It does not matter when you applied. You will get the 10 years green card if at the time that you becomes permanent resident  (if you do consular processing oversea, that is the moment you first enter the US with your immigrant visa, if you do adjustment of status from inside the US, that is the moment your I-485 is approved by USCIS), you are already married for more than 2 years. The 2 years starts from the date that you officially legally married on papers, not the wedding date where you have big party.
