the stressful "Decision cannot yet be made about your application"

Finally, I went to the interview for the second time. I was called by the ticket which they gave me inside . Th supervisor came and we came to the office. He told me that all the question would be about my arrest and what was happening there that night. He told me that he is writing my statement and they they would see . He asked about ALL facts that was there that night and it took him for about 2 hours. And the end when we finished he told me that it is a possibility that my case would be denied because I was arrested in a 5 years “window” but I should not be upset cause I could apply for a new n-400 in 2 years BUT it’s not a final decision  let’s wait until they would compare all the facts BUT he thinks ( as he told me ) it would be denial )  he gave me a “decision can not be made yet” and wait up to 120 days :(((((((( P.S it doesn’t matter for them if I was Convicted OR Not - the probably case and my idea that night was to think of a commit a crime ( that what I was told ) .... I’ll wait for the final decision .:(

Did you asked your lawyer about the petty offense exception?? if you have only one crime you can get the exception.  i think you should talk to your lawyer about that. I am not a lawyer but he should know that.

wow you are still waiting. Have you talked to your Lawyer about de novo review of the case? its the same as mandamus but in that case federal judge has to take action on your application unlike adjustment of status in which federal judge tells uscis to make a decision on the case. 

This just pisses me off that for no reason you have to wait so long. when are you thinking about filing a mandamus?

Yes, it pisses me off too!

 

My lawyer wants to wait a bit longer, so I'm trying to be patient. Also, it costs $5k to sue them, so I'd prefer to resolve it without spending that, but it is looking like I might need to go that route.

 

Right now I'm just following up with Congress people, emailing etc.

Yeah that is a good option to email the senator or the congressman since its an election year. Have  you contacted any other attorney which might be able to do it little cheaper price. Your case is straightforward so if you wanna go that route.

Yes, I keep pushing the Senator and Congress person (only 1 Senator responds though, Schumer in NY is useless). The Congress person is great though.

 

I checked around the forums, and $5k seems to be reasonably standard. My lawyer is very good, so I'll likely stay with him for it.

Is there any update on your case? What was the reason that your case got stuck?

Is it possible that your ex-spouse filed or provided USCIS/ICE any accusations against you?

I had seen 2 people who had that happened to them, and their case just went into limbo for years.

 

Or maybe they found something bad in background check?

I have also heard USCIS delayed someone's case only because the background check caught something from someone else that had the same names as the applicant...
