Keep waiting. it took me 167 days from interview and that was years ago.  I know some will tell you that you can take it to court but with your case I would wait it out.

I'm sorry to tell you but 120 days has not passed yet. From what I gather you are adding weekends and holidays, that is most likely why the office informed you that it could take a while. Remember that USCIS does not count weekends or holidays as the local offices do not work on these days. Have you sought assistance from your Senators for FL? or your local rep? If not, I would start there!

You should take action and file a complaint with the ombudsman and your federal representative at the very least.  It clearly states on the N-652 you received in the interview that § 1447(b) provides you with the right to request a hearing if "USCIS has not made a determination on your application within 120 days."  You should document that USCIS told you otherwise to help build your case. 

 

My case is different, I was recommended for approval, now my case is stuck for ~70 days and the "Estimated Wait" keeps moving up sitting at February 2021.   I call and send a secure message every 30 days, I plan filing with my federal representatives at 90 days, (it takes USCIS ~30 days to reply to them) and will write the ombudsman at 120 days noting that i will file with the court if a determination can not be made by USCIS.  I will file with the court shortly after that. 

 

There is no benefit to not following up.  If they want to deny you, you are only giving them more time to build a case to do so by not following up while also delaying your ability to file again after the denial.

This is absurd. if i am you i will file mandamus and threaten uscis with a lawsuit. They are suppose to give an answer within 120 days by doing this they are violating your rights. i will also reach out to your state senator and tell them the whole story. As some people waited 2 years or less for decision that is not acceptable. file a mandamus or atleast threaten them.

I know the pain of wait and waiting this much already is not helping you or the application. what if you get arrested in the mean time again for something else? i am not saying you will but everyone has a bad day. dont wait file mandamus.

These uscis needs to stop playing with people emotions. They keep giving every one run around i think you have everything sorted out and i would go the same route which you have planned good luck with everything. keep us posted.

In 2012 i've got my Green Card. no violations\no parking tickets nothing. I explained him FROM MY SIDE what had happened that night and I Said BUT the Case was Dropped and dismissed but He smiled and said IT WAS NOT DROPPED , it was NOLE PROS (no prosecution). Then he  Printed me a form -  I ve Passed but Decision cant be made yet" And He said that It takes SOME time (2 weeks) you'll receive  it BY mail (the decision). Since THAT day - im checking every time online  No information ( 5 weeks have passed). "YOU ATTENDANT YOUR INTERVIEW -You DONT NEED TO DO ANYTHING THAT TIME  Estimaited Time 3 Month!" 

I cant sleep , i so stressed out. And IM so scared that it a HUGE possibility that they will DENY me. (One of my friends WITH CONVICTION of RECKLESS Driving Got his Citizenship in 2 Weeks with the same (Decision can not be made) and i'm frustrated. So i would be very happy if you can help me with this situation a lil bit!  THANK YOU! GOD BLESS AMERICA!

Same situation here but I wasn’t convicted. My interview coming up on March  iam really scared I don’t know what will happen. Praying for u to hear some good news soon about ur case . 🙏

No need to be afraid. Nobody is perfect hopefully everything is going to be fine if you show to the immigration officer that you are afraid he will suspect more. Be confident and show remorse that such act wont happen again.

File a mandamus cost money ...Why do people should file if they paid fee to get desicion after 120 days?

Your point is valid but i have heard stories that they dont adjudicate cases within 120 days so have every right to sue them after 120 days have passed, i hope it does not come to that point but waiting further does not make sense either since you paid fee to get naturalized. Everyone situation is different so i can only speak for myself since i will not hesitate and file the mandamus against uscis after 120 days have passed.
