Hi everyone, my fiance and I are just starting to fill out the I-29F but have what is hopefully a quick question.  I have 2 children who will be moving with me (from Canada) when this process is complete.  If we file the I-29F now, we are worried that if it goes through too quickly, we may have to move in late spring before school is out for the year, which would be less than ideal for 2 kids about to start high school.  Alternatively, if we wait too long, we don't want them missing the first few weeks starting out at a new high school. 

 

Ideally, we would really, really like to make the move in the summer.  Obviously there is no guarantee how long this will all take, which makes it near impossible to try and figure out when we should be filing everything.  GAH! I have seen online that the consular officers can do a revalidation that is good for 4 months at a time, but the USICS info about that is severely lacking in that they don't tell you how or why those revalidations are done.  I tried emailing the consulate about this and even though they responded, they basically just directed me to the website and said that consular officials have the authority to revalidate the petition but aren't legally required to do so.

 

If it seems likely that we would be able to get revalidated if we needed it, that would be ideal for my kids.  Hoping someone can chime in about their experiences with the whole revalidation thing.  Thanks!

You are dealing with Montreal,  you don't have to worry about it moving to fast.

 

You won't find much on revalidation on USCIS because they don't do it, the consulate does.

You have up to 1 year after the petition is approved to complete the visa process at the embassy.     And you have up to 6 mos. after the visa is issued to enter the USA.

Explain that then to individuals who have had there visas denied due to expiration of the petition because the consulate refused to extend, even though they were under the 1 year mark.

I just want to comment on the schooling. I pulled all 4 of my kids from school in May. 2 in HS 9th and 10th grade, the other 2 were in 5th and 7th.  All 4 kids were promoted to the next grade by the school in Canada. So don't worry about pulling them early unless it is that they want to graduate with the rest of the class. The younger two,  the school even mailed their last report cards to us. The older two the HS had printed everything out when I pulled them.

Well that's good to hear, thanks! My kids do well in school so I hope that the same would happen with them if it comes to that.  They are just in their first year of high school here (grade 8) but high school where will we be moving starts in grade 9, so that will be a plus too, and I'm sure having an extra long summer vacation won't bother them one bit ;) 

 

I'm still hoping to move in the summer though. We'd really like the wedding to be in October for logistical reasons but I know that it may not be possible.

Just as an FYI - Noting that the VJ averages are averages, and your case can easily be faster or significantly slower... right now you'd expect about a week from sent to NOA1, 3 months from NOA1 to NOA2,  7 weeks from NOA2 to NVC ready, and over 2 months from NVC ready to interview in Montreal. So you'd be looking at a late April interview on average, which should give you plenty of time for your kids to finish school.
