CR1 after K1 that could not be completed

My fiancé and I went through the K1 process, it was accepted and the visa was approved. Unfortunately, before my fiancé (from China) was able to return to the US became ill with a stomach virus that required months of treatment which caused us to miss the K1 window. We attempted to get an extension through the consulate due the nature of the issue with detailed explanation, doctors notes and everything else they requested but it was “denied without prejudice” according to what was stamped on the visa. My question is at this point would we be OK to attempt a CR1? We would plan to travel and meet in Canada to get married beforehand then submit the CR1. Are there any time restrictions on case submissions or any other issues that I am not aware before we proceed? Any help or guidance would be appreciated, thank you.

Yes, a CR-1 at this point is 100% fine (and even suggested IMHO). Good luck!
