Reason to Expedite -Financial Hardship

Hi,

 

My husband was working for the airport in a contracted position. They gave him a letter cancelling his contract because they are out of season. Is this a good enough reason to ask to expedite his case to come to the US sooner?

The hardship needs to be for the USC not the foreign spouse so I would say no. But I also would say it's worth a try. The worst thing that can happen is that they say no.

Thanks, he is looking for another job, but I wondered if job loss for him would help expedite the I-130.

The hardship has to be on the USC.

Yes the hardship needs to be on the USC, but you could say you need to support him financially because of his job loss and it is causing undue burden on you the USC. BUT, I will say requesting a financial hardship expedite is a double edge sword come interview time...

 

You are giving the Consular Officer an additional factor to make your spouse inadmissible on public charge concerns because you are encountering financial hardship. Again, since your spouse's income is not included on the I-864 and its only you the USC financial information, you could be safe to try for a financial hardship expedite. Just realize it will cost you time because people have been in much worst medical and financial situations and not approved for an expedite request.

No harm in requesting the expedite.

 

That said, if losing a job was cause for faster processing, I could foresee a lot of job losses in the future.

There is literally no harm in trying. I expedited for similar reasons (and medical reasons) at one of the toughest embassies in the world. Worked just fine!
