Submitting Supporting Documents after Filing

Hi,

 

I have a quick question... I already filed my I-130 in June and my I-129F from in August. I have visited with my husband since the filing. Would it be helpful to send additional supporting documents i.e. proof of visiting after filing, text messages, and upcoming travel dates.

Side-load it at NVC. In general, they won't accept new evidence at USCIS without an RFE.

Thanks, but was does side-load mean. Should I sent it to the address below, and what department do I sent it to?

After the I-130 is approved, the case will be sent to NVC. You can upload the documents to NVC at that point.

My I-130 has not been approved... So do you suggest not sending updates?

In general, USCIS will not accept new documents without an RFE. You can submit more evidence at NVC once it reaches that stage.

Perfect, thanks. 

 

One more questions, I had no idea that I was not supposed to send the I-864EZ after sending the I-130 form. When I called, no one knows where it is.

You will do nothing and just wait until I-130 approved and send to NVC, then you can send what we called side-load evidence.

I hope that it will be approved that soon, according to the USCIS there is a 12 -15 month wait at the Nebraska Center.

The I-864 will be submitted again at the NVC stage as well. The one submitted with the I-130 will be ignored (USCIS won't look at it as it's not needed for the I-130).

I just wondered where the paperwork went to, but I never called the NVC.

An I-864 by itself is not assigned a case number (it's not an application or petition), and it doesn't apply to a solo I-130 either. So at best it was matched up to the I-130 and ignored. At worst, it was just completely ignored and/or discarded.

NVC will have no record of anything prior to USCIS approval. The workflow is USCIS -> I-130 approval sent to NVC -> Interview scheduled at consulate.

You have almost a year to wait until hearing about the petition approval at USCIS.  After that you will upload the beneficiary's civil documents, your financial documents and I-864, and complete the DS-260 online all via the CEAC website to the NVC.  At that time, you can scan all your additional evidence of other visits, time spent together, and financial co-mingling documents and upload this as an "additional document" via the CEAC website, this is sometimes referred to as "side-loading" additional evidence.  You have many months to prepare these documents and make other visits before the petition is approved.  Good luck!
