Hi. I'm the U.S fiance and sponsor for my fiance in the Philippines. Long story short, my income is well over the requirement but I have a large tax lien from past years. BUT, I have a letter from IRS stating that my case is currently closed and deemed "currently not collectible".  It goes on to say that I still owe the debt and they will put a lien on me to protect the IRS' interst. It also says that I need to take no further action now. And it says that if my financial situation changes for the better in the future, they MAY restart collection efforts. it says I can make voluntary payments if I choose. All tax years have been filed. I'll be current with year 2019 taxes by the time  of the interview which is the end of this year. Will this case closed letter protect me from denial?

You should provide the current year tax return transcripts for the interview.

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Yes. I will be providing 2018 tax year bc it is the last tax year filed. But I owed taxes for 2018.  And that amount and tax year was included in the non collectible letter. I was going to take the letter, 2018 IRS transcript (which shows I owe but is included in not collectible status), and proof of 2019 tax payments to show I'm current in 2019. This is because the letter also says that I have to stay current with future taxes.

You will need to provide the 2019 tax transcript as that is what Manila requires.   USCIS does not care if it was been paid, just that it is filed.   Realize that you will be expected to have 3 years at the AOS stage if your K1 is approved and you get married.

The interview will be this year in 2019. 2019 taxes can't be filed until 2020. That's why I was saying I was gonna bring 2018 tax transcripts bc that is the most current tax year. And just to be safe, I was gonna have my fiance have the 2016-2018 just in case they ask for further proof of income stability.

Just a FYI, it seems rare if Manila asks for any financials or an I-134, seems like it been that way for a few years now for a K1 Visa.

2019 is not available as that tax year is not yet closed and therefore hasn't been filed

Embassy requests the most recent tax return/transcript and W-2 (if not self-employed).   They look at the gross income as noted on the tax return, as long as the income meets the 125% poverty guidelines you should be fine.

 

 

Embassy does not ask about debt or lien information.      

 

 

As noted already, it is quite common (since 2014) for the embassy to not ask for financial support evidence with the K-1 visa .. it is listed as required documents and they do ask on occasion so still need to be prepared.
