affadivit of support help please

I'm preparing for the next stage after NOA2 now, and to be honest the affadivit of support baffles me completely.

My fiance, the US citizen, earns more than the 125% poverty line, yet the majority of her earnings go straight out the bank to pay off a stuent loan, so her monthly balance on her bank statement is always tiny and in reality she can't support me.

I am the alien, yet i have no debts and a decent amount of savings, which means I'll be able to support myself when I move to the US.

So what i'm trying to find out is whether my savings will be taken into account at the interview or will I have to transfer funds to my fiances US account to boost her affadavit of support app?

i used to think of myself as reasonably intelligent before i started this visa process, but i'm finding this seriously confusing and over my head.

Timeline

If your fiancee is earning more than the requirement, then that is sufficient. They are not concerned with her monthly budget and where that money goes (except, of course, if she were supporting dependents). I don't see any reason to "boost" the affidavit of support - you either make it, or you don't.

They can care less about where the $$$ goes, you do not even need to provide bank statements. They are not consered with foreign persons finances either they are concerned with US Citizen's ability to provide support.

My income exceeds 125% of the poverty line so did not bother listing any assets like bank statements ect..

In our case this what the I-134 included.

  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past 6 months pay stubs up to a few weeks before the interview

When you get packet 3 from the London Embassy, you'll get a long sheeet of information on how to show support. That can be done EITHER with the I-134, or with a independently created affidavit of support. You also have the option of showing that you can support yourself. They Embassy tells you how to show your own support.

1-23-07 NOA1 Notice Date

5-10-07 Arrived at NVC/5-14-07 Left NVC - London-bound!

5-17-07??? London receives?

Be cautious of 'boosting' her account if bank statements will be used as supporting documents for the I-134 as large deposits from you might be misconstrued. B)

Also, I was wondering about question 11 of the I-134. Is it sensible to tick yes 'i do intend to make contributions' even if the 'specific contributuons' haven't been decided yet?

We may stay in her parents house for a few weeks when i first move over there, but nothings been finalised. I guess that word 'intend' means that this isn't a binding statement though and it seems wiser to tick yes rather than no.

In which case you may not need a sponsor for your K1 visa. Document your ability to support yourself well. Others from the UK have been successful with this.

Beyond that, as others have posted, there's no need for a sponsor to report debts other than those debts that are secured by reported assets (so as to determine the net value of the assets).

That question doesn't really apply to K visa situations. Look at the "example forms" section of VJ and see how that form was filled out. The I-134 is used for A LOT of different visas and processes, it's not quite a one-size-fits-all form, but it gets used that way. Some of the questions, then, seem a little confusing or oddly phrased.

The answer to that question for us here is most often "N/A"

Yes, it is sensible to tick 'yes' to I-134 Q11.

At the same time, the anecdotal evidence clearly indicates that it makes no difference how a K-visa sponsor answers this question. So answer it however you feel comfortable answering it.
