thanx for responses.. actually my issue is that my wife went back to usa just after 2 days after marriage. circumstances didnt allow us to live in home in india. it my marriage was last year in oct and since that time we couldnt get chance to meet. we stayed in hotel after marriage for a night only. my confusion is whether can we use that hotel stay to write in i-130 that we lived together for that day?

if can't write that night as lived together then can i explain why couldn't we lived together after marriage on last pages of i-130? can i mention hotel stay in that explanation?

kindly help me to compile my i-130 package as i am doing this without attorney as having some problems.

it would be a great help if i may get a already approved i-130 file sample.

i have some issues with compiling my petition like index, and how to make my petition very systematic. i know sequence of papers but how to introduce all those papers in index of my petition that's the confusion

Generally, a 24 hour period is 1 day.

What exactly is the issue you are having?

my issue is that we didn't live together after marriage. my wife migrated to usa last year and she  is working hard to earn enough to fulfill requirements for my immigration like affidavit of support etc. and my visitor was was not granted by embassy. what should we write in lived together question. how to justify it??

You don’t need an index and you don’t need a cover letter. You need the correct forms and the documents needed for the forms and the payment. Paper clip it all together.

Do not list you lived together for 1 day. That is just nuts and no matter how you word it it is not accurate.

If you want to show how you met and how your relationship evolved then write just that. Write about how you met, how long you have known each other, how long you were engaged, and about the wedding. Who attended and such.

It does sound like your wife is from your area. If she was from there and you have known each other all this time document that.

Where are you asked how many nights you are spent together?

Many (probably most) CR-1 couples did not physically live together for a long period directly after marriage occurs (well, at least not before the foreign spouse enters the US, in many cases).  It's not an issue.

Send the final divorce decree.

On what basis (visa) did your wife immigrate to the US?

She can submit an I-864 with only 1 tax return if she was not required to file prior years. She would mark that she did not file for the 3 years on the I-864, then provide a reason for not being required to file (was not a resident for years x/y/z).

Why did she not file US taxes last year? If it's because she did not have income (or it was below the minimum threshold) that year, then she would note that reason for that year.

No "love story" is needed. IOs and COs are not swayed that way. Focus on evidence - time spent together in person first, then things like financial commingling (being beneficiaries on insurance or retirement plans is one way even when you live apart), then things like photos, chats, calls, etc.

My wife is Green card holder .actually she migrated to USA in June last year so she could work for 5 months only.she filed tax but that doesn't satisfies minimum requirement of usics which is around 21500$.but this year she will earn this much that's why we can use only this year return only.

We are attaching all the evidences related to our relationship but Actually without story how can they come to know about the relation of the evidences with us .

What visa did she get? Was it from a different spouse, or was it from another family member, work, etc.?

So she did file last year. It just wasn't enough to support you. No issue - her current income is what matters most, not tax returns (unless self-employed...then the most recent year's tax return is the current income as well).

I never sent a story with my case and the evidences spoke for itself. The visits are the main things that tell a story.

She got visa through her maternal uncle.

She immigrated to USA last year in June so could work for 5 months only but this year she can work whole year.we are thinking that as  I 130 takes time for approval till.that she will able to earn sufficient money for affidavit of support. Kindly tell me whether her income can i-130 petition ?

We are in relationship since last 5 years and finally did marriage against will of parents last year in October. Her parents agreed on condition that bring me also to USA. That's why she is working too hard to fulfill minimum requirement of income. We want to meet each other but job is important for her as she is working in a company and they company don't allow long leaves that why she didn't come to meet me after marriage but u tried visitor visa to meet my wife which was denied. Does offices see sympathetically such issues??

That all sounds pretty standard (including low vacation days in the US and denial of visitor visa).  Working 5 out of the 6 months she was there shows she tried to get work pretty quickly, etc, and she’ll have better income to show by the time the petition gets to visa stage. On the face of it (and assuming relationship proof is there) I don’t see any problems with this situation.
