K1 and K2 AOS before october 15th

Timeline

My fiance entered the US sept. 11th, and i later saw the public charge rulings change october 15th. We were marries sept. 20th (certified certificate will be a few weeks) So we are trying to send everything in before that date. (250% above poverty level is ridiculous)

 

I am making this thread with all my questions.. The list of documents in total i am sending is-

 

Cover letter

Check for $1975

G1145

 

--K1

I485 + marriage certificate (not certified, will send certified if rfe appears)

copy of passport and k1 visa

NOA2

I94

Birth certificate

Passport fotos

I693

I864 affidavit of support (i am 198% above poverty guideline)

I765

I131

 

K2 (4 years old)

I485 + marriage certificate

copy of passport and k2 visa

Birth certificate

Passport fotos

I693

I864 affidavit of aupport

Questions i have:

1. Are these all i need to send?

 

2. The i485 asks for all children including step children, would i list my children there as we are now married and they are her step children?

 

3. Do the birth certificates need ro be translated?

 

4. Will i be sending evidence of the relationship as in the i129f petition?

 

5. When filling out the forms, can i sign as the interpreter and the preparer? my fiance only speaks spanish and very little english.

 

6. My fiance needs 3 vaccines according the CDC reccomendations (she has none and is 26). Her son needs 1 vaccine. (he was up to date, just lacks 1 now).  What do i send the ds form for vaccines and the i693 vaccine portion, or just i693 vaccine portion?

 

7. Will there be a cover letter for the EAD and AP documents?

08/21/2019: Medical - passed on vaccines so insurance can be used in the USA.

08/22/2019: ASC

08/27/2019: Interview -APPROVED!!!

09/11/2019: Entered USA through Chicago O'hare

09/20/2019: Married

10/09/2019: Filed AOS

11/12/2019: Biometric appointment

12/13/2019: RFE (birth certificate)

 

 

Total time spent together before K1 interview: 65 days.

The minimum FPGL will still be 125% for K1 AOS.

I485 + Photocopy of original or certified copy of marriage certificate (not certified, will send certified if rfe appears) Sending your I485 without the correct required documents to hold your place in line could cause an immediate denial especially at this point in time where everyone is filing to bear the deadline. Check out the policy change that came into effect on Sept 11th, 2018. I wouldnt.

I765 plus I765 required documents (if you want an SSN for the child to file taxes next year you will an EAD for the child).

 

Questions i have:

1. Are these all i need to send? Elaborated above

No. Only the I129F Noa2 Approval notice.

Yes

 

6. My fiance needs 3 vaccines according the CDC reccomendations (she has none and is 26). Her son needs 1 vaccine. (he was up to date, just lacks 1 now).  What do i send the ds form for vaccines and the i693 vaccine portion, or just i693 vaccine portion? Just the I693 if the vaccinations were not completed abroad and signed off on their DS3025s. Double check and reasearch this issue as there is usually great confusion.

Not dumb but your best bet would be to join the August and September AOS thread as everyone is at the same stage as you and would have asked the same questions.

Note i plan to send in a copy of the license and certificate that was filled out after the wedding.

 

License has license watermark in the back with raised seal, and certificate just has certificate watermark. said a certified  copy will take around 3 weeks.

Youll send a photocopy of the one you get back from the county.

Anything else is not considered an original or certified copy as it has not been registered by the county as a legal marriage until it's recorded by the county. (Understanding that there will only be one original that you could ask for certified copies of).

Ditto for the ML as it doesnt prove your marriage is legal.

How did this go for you, sending in a non-certified copy?  Did you get an RFE, a NOA1, what happened? I may be doing something similar soon.

MN law requires a marriage to be entered into the state records within 10 days of the receiving the conoleted marriage certificate.  so on day 10.. i called them and asked "soo... its day 10, is it entered"  they told me theyre were entering it in when i called lol.

 

drove there same day and bought a certified copy right after they sent out the free certified copy.  But we just received the biometrics appointment letter on saturday.
