How many are filing N-400s before the I-751 has been approved?

I don’t know if anyone has experienced a 41.5 month waiting, but I’ve seen cases dragging for a long time.  From that standpoint, a USCIS field office can technically review an I-751 case 41.5 months after the application date and still be within processing times.

Yes, that's shocking. While I've never heard of someone's case getting stuck for that long at a local office, it is definitely something we have to consider. Yikes!

My local office is Seattle.

1-751: Sept 4, 2017

N400: Sept 2, 2018

 

A friend of my mine applied for her I-751 on September 5, 2017 in Seattle, and she received her 10-year GC in December 2018. She applied for N400 in March 2019 and her interview has been scheduled in November 2019 in Portland.

Note that the timeframes on that website cover the 50th percentile to 93rd percentile (see https://egov.uscis.gov/processing-times/more-info). The 41.5 months is by far an outlier, not an expectation.

Therefore, regarding field office jurisdiction, 50% of I-751 petitions are adjudicated in the first 21 months; the next 43% are adjudicated in the next 20.5 months (or 41.5 months total) and the remaining 7% are considered outside processing times (that is the point when you can submit a request) and are reviewed after the first 41.5 months.  

 

It is noted, that “We calculate processing times by using historical data of completed cases. We cannot project how long it will take to complete a case filed today.”

 

@geowrian what do you intend to do when the N-400 window opens and your I-751 has not been reviewed at that point?  Any thoughts?

That's up to my wife (she's not 100% on what she wants yet), but presumably she will file under the 3 year rule once she is eligible.

@Dongbei @geowrian hopefully it plays out fast if you do decide to move forward with N-400 while I-751 is pending.  Or even better, let’s hope that everyone is approved and we don’t have to face that dilemma when the time comes.

This is my thinking, too.  Therefore, my wife plans to apply as soon as she is eligible....in March 2020....I-751 pending or not......I don't see any downside.

Apply N400 is a good ideal if your local office is not busy. For my wife, her local office is Dallas and N400 for Dallas office is around a year, so we will wait until I-751 done first before thinking about N400.
