Hey Guys,

theres not enough information about this topic and I wanted to ask it as I’m still unsure and this is a grey area. I will be filing a CR1 visa for my husband residing in France. 

 

I have been unemployed for the past two years due to traveling abroad and living with him for few months at a time. I know I have to show three years worth of tax transcripts. I don’t have anyone to ask to be a joint sponsor. My questions are below. 

 

1. If I get a job right before I file my CR1 paperwork (it covers myself and my husband above poverty line) would that be ok or do I need to show I’ve been employed for at least a year?

2. If I have enough in a savings account, will that be accepted? I have a good amount in my savings. I keep reading that income is better than using assets but what if assets is a good solid amount?

My husband is in France, too. For my I-864 I showed my current income (hours per week x 52 weeks), letter from the employer, copies of the latest pay stubs. Plus 3 year tax transcripts with W2.

If you want to add the assets, keep in mind the total of them should be 3 times the difference.

The consulate officer at the interview accesses the totality of the circumstances, each case individually to determine financial eligibility of the sponsor.

You filed your taxes anyway, right? So submit those together with a detailed explanation. Also, a letter from your current employer stating your annual salary. Also, the assets with all the documents proving your ownership of them.

The first thing to read is the I-130 instructions.  When you do, you will find that an affidavit of support is NOT in the list of supporting documents to submit.  You'll submit the affidavit of support perhaps a year later at the NVC stage.  THEN, become an A-Student of the I-864 instructions to learn how to use both income AND assets to qualify as sponsor.

 

The actual instructions will be more helpful to you as a starting place than anecdotal writings.  Once you've studied those instructions, you many still have questions but you'll have a better foundation from which to ask them.  Without studying the instructions, you have no way to know what it is you don't know or need to understand.
