What exactly is this supporting documents?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Just a question I added her onto my bank the other day and of course they checked her passport just as a form of ID, there should be no issue that her passport was checked when she is "out of status" right?  The banker lady added her just fine onto my account and everything.

Not an issue......good luck.....  Here is an article which explains the difference between lawful status, authorized stay, etc which I found to be helpful.

"Period of Authorized Stay

Even if a foreign national is, for a period of time, not holding a lawful nonimmigrant status, s/he may be in a “period of stay authorized by the Attorney General” (i.e. period of authorized stay). One of the most common situations in which this occurs is when a properly filed application or petition to extend or change nonimmigrant status is filed with the USCIS on behalf of a foreign national.

A request to change or extend status is only considered properly filed if it is submitted while the individual is still in a valid nonimmigrant status. As explained above, this generally means that the foreign national holds an unexpired I-94 and is complying with the requirements of the status indicated on that form. In most situations, if the individual’s status subsequently expires while the request to change or extend status is pending, the foreign national falls out of nonimmigrant status, but remains in a period of authorized stay. This period of authorized stay continues until the USCIS issues a decision on the pending case. If the application or petition is approved with an extension or change of status, the decision has a retroactive effect, meaning that the period without status is cured. If it is denied, and the I-94 expired since the application or petition was filed, the individual typically begins to accrue unlawful presence from the date of the denial.

Another very common example of authorized stay is when a foreign national is present in the United States while an application to adjust status (I-485 form) is pending. An adjustment-of-status applicant who does not also have lawful nonimmigrant status (e.g. H or L) generally is considered to be in a period of authorized stay, as long as the properly filed I-485 remains pending."

I just thought I would ask here on this thread, if its not exactly in topic with this thread I can always make a new thread its no biggie, but we were curious about this part of the I-485 where we are asked to use any other names since birth.

Should we put her maiden last name here, we are going to fill out all her AOS paperwork in her new married last name, so where it asked for legal family last name we are going to put hew new married last name.

The bank does not oversee legal presence.  That's ICE.

Yes. Her maiden name is now a previous name.

tysm both for the clarification, helps so much, if I could also ask, was looking over the travel document I-131, and it asks about date of intended departure, expected length of stay.

 

She wants to get the travel auth INCASE she needs to travel back home to her home country during the process of getting the GC, but we/she isnt sure of a date, or length, so we are not sure what to put here for her.

If no trip is planned, just write "unknown."  Approval for the advance parole is not contingent upon having travel plans.

let us know how that works  out.  My wife could not get even an ID until she got her EAD card.  Could not get her on the main bank accts, but got her on the lessor one after a lot of work.  Every state is different.

Yes, she did.  I think one of the problems were that her SS card was put in her married name, and her passport in her maiden name.  This is Arizona.

In part 2.a-2.c of other names used since birth on the I-485 does one only put in the previous Last name and exclude the First/Middle if those are staying the same and only the Last name is changing to married?  

 

Or just re say the first/middle name even if staying same after married and put on previous aswell?

You might be out of luck on the state ID. My wife got hers while I94 was still valid, and it was limited term ID until she received EAD AP card. They said here in Nevada they couldn't issue an ID card if you're out of status, but every state is different. I would check the state DMV website to make sure you can get a ID card. It listed all the documents required for a immigrant waiting on AOS. I am sure most States have a list. If you're in California, no issues, they will give an ID to any one that walks in and has a pulse.

Any former K1 visa holder who's I-94 has expired and if they have yet to file I-485 is out-of-status.  Deportation proceedings are a long way down the path from being out-of-status. That being said, the current Federal executive administration (MAGA) has called on ICE and CBP to initiate "enhanced immigration enforcement." It is known that CBP has been operating mobile immigration checkpoints along the southern US border. Additionally, ICE agents have been known to "visit" egg farms in Minnesota looking for undocumented or out-of-status aliens. There have been rumors of enhanced immigration enforcement at domestic airports. Should your out-of-status alien run into any of these enhanced immigration enforcement stations, they may be detained until they can have a hearing before an immigration court judge.  It is estimated that currently there is a more than one (1) million case backlog in US immigration courts, https://www.wsj.com/articles/u-s-immigration-courts-backlog-exceeds-one-million-cases-11568845885 . Would you like to have your newly arrived alien spouse be detained until you can have a hearing in front of an immigration law judge? 🤔

 

File your AOS/EAD/AP applications ASAP, avoid this potential nasty pitfall, and quit messing around with semantics and other topics of minimal consequence. ICE and CBP enhanced immigration enforcement is real and could be coming to a home near you !!

yeah we are working on the AOS currently as we speak, not really messing around just was getting documents together, and it took some time.
