Hi, 

 

When filing a I-485 and the included I-864, it is my interpretation from the I-864 instructions that we needed to list the I-129 Beneficiary who entered on a K1 as the principal immigrant and minor child who entered with the beneficiary on K2 as an additional sponsored family member (part 3).

Received an RFE requiring that we must submit a separate I-864 for each minor child, listing them as the principal immigrant.  Very confusing.  Anyone else had this issue?  Is this special requirement specific to 485?

Each immigrant needs a seperate i864. 

Each immigrant will be the principal immigrant on their own I864.

The K2 will be the derivative listed on the K1s I864. 

Each immigrant will be listed in the household size for each I86r too.

Something sounds amiss. When we filed for my wife's (K1) and stepson's(K2) we strictly followed the instructions of the VJ K2 AOS Tip Guide, https://www.visajourney.com/content/k2-visa-adjustment-of-status-tips/ , and were approved with no RFE generated. Did you follow that guide?
